In CO, each person that signs for a DL gives their consent to a chemical test of their blood or breath. Refusal to submit to that test results in revocation of their DL for a year. In the case of suspected drug use, only a blood test is offered.

We would combine the driving behavior, the smell of marijuana in the car and we would run them through field sobriety tests. As I posted before, CO statutes state impaired to the slightest degree. If you're driving is ridiculous, you smell like dope and say you smoked a joint or took a few hits, well chances are you're impaired lol.

Stopped a guy in a semi who said that he didn't want to smoke weed around his kid....so he kept the weed in his semi, which violates federal law.

Messing around with that shit is just dangerous, just like booze.

You can't shelter your children from everything their whole lives. At some point you just have to trust that you did a good job raising them so that the government doesn't have to tell hem what's right and wrong. This whole idea that we have to legislate morality has cost us a metric shit-ton of money and really gotten nowhere other than creating black markets and more crime in additional to criminalizing something trivial.

This is America. You should be free to make your own decisions... right or wrong.

Blacktacoma, it all depends on the amount of THC and the rate at which it is circulated through the blood stream, just like it depends on the amount of alcohol in the system.

The state has yet to determine the actual level of THC in the blood before certain things get charged but CO law reads "impaired in the slightest degree."

If you're weaving, driving slow then fast, crossing lines, driving like you're impaired, chances are you're going to jail if you admit to having smoked weed recently. And weed is a lot more potent to smell then alcohol.[/QUOTE]

1st off, I'm glad the amendment passed. I believe fighting the war on marijuana was a waste of time.

But I definitely agree that there should be laws against driving under the influence. My only concern is how that level of intoxication is determined. Since weed stays in your system for so long do you think a blood test is fair? I understand the argument that since it is in your system it can still be effecting you; but tests have shown that texting and driving is more dangerous than smoking and driving. Although driving while stoned is definitely not okay, its a lot different than driving while it'll show up in your system. I'm just curious as to how this will be tested. If the car smells like pot and you find it, then case closed, they can't prove they weren't smoking. But what if you pull someone over for some minor violation like not signaling a turn. They/the car doesn't smell, there is no weed in the car, but their eyes are red. There could be a handful of legitimate reasons why they're eyes are red, but you want to blood test them. The last time they smoked was a week ago, but it will show up on a test. Does that count for driving while high? Could they refuse a blood test, or would you need more evidence against them being high?

I'm not trying to bash the system or anything, and I doubt counties were really anticipating this amendment being passed (so I don't expect you to have a concrete answer), I'm just curious as to how you think the level of intoxication will be tested.

As long as stipulations are put in place similar to DUI with other narcotics and or alcohol in your system Im okay W/ it. They'll tax the heck out of it...then again-higher tax rate will result in more street drug deals....

Spoiler alert: many of those UI drivers operate the vehicle at speeds LOWER than the posted limit in fear of speeding too.

..In my exp when there's one who is high there's a good chance there's more...then distribution can get tagged with it...I bet more dist charges will be going along with the new legalization...

    ^^^ Who dat?

    :D

If you want to stay legal and not raise any suspicion don't smoke it at all in your car or truck. You shouldn't be drinking in it and you don't keep an open bottle it because you could get busted so leave the pot at home. Besides that smell once in your vehicle, will kill the resale value. Just like tobacco. It stinks.

Please don't, If it's just because of marijuana we don't want more people here.
    So true.

I know I said I would not move again but if this attracts a bunch of patuli oil smelling pot heads then I will look for another state to live in. I don't care that people do it but I know most who will use it will not be responsible about it and cause more problems than anything.
