Used Dealer sold me a 2012 with only 3000 miles but old tires. Advice

    buyer beware.. some salesperson pulled a swap..i imagine they clean out the coin pocket too :D

    IMHO I would look up the price of new 235/70/16 tires same brand and everything.. and then half that price.. because they are used ( put all this in writing) and ask for that amount of money toward new tires ... you are more than likely to get that versus new tires.. and that gives you some $ towards the beefy tires you want.

    Caveat emptor ... basically, the buyer can not recover damages from a seller for defects on property ... in this case your Tacoma ... that rendered the property unfit for ordinary purposes. The only exception is if the seller actively concealed latent defects or otherwise made material misrepresentations amounting to fraud.

    1. The truck drives and passes inspection.
    2. The dealer did not mask, hide, or replace the tires between agreeing on the purchase and closing the deal.

    Damn ... and all this time I thought I had fallen asleep in that class ... :cool:

    Sorry dude ... save your time and money and head over to Tread Quarters.

    Im the other Salesman. Not a chance are they swapped. I have a lift with 275 70 17 BFG All Terrains on mine. With Fuel off road rims. I have my original set of BFG Rugged Trails and rims off mine which SUCK in my basement... :D

    Don't let this eat you up. It is not a big deal. You bought the truck as is and have no legal recourse with the seller unless he wants to be nice. Just think of it this way....at least you don't have to feel guilty about throwing away the old tires when you get new ones. In fact, you might want to swing by the dealer and leave them with him as it sounds like they could use them.

    I agree don't let this eat you up or ruin the purchase of a new truck. Go on line and file a complaint with State AG's Office of Consumer Affairs and the Better Business Bureau. This will at least cause the sob who sold you the truck some grief, probably it won't get you a new set of tires but give you some satisfaction. Go buy the tires you want and don't look back. Enjoy the truck.

    Repo - means the PO likely swapped out the new tires and sold them to make a buck, or swapped them for a friend/family member knowing the truck was going to be taken.

    Shame on the OP for not carefully and fully inspecting the truck BEFORE signing and driving. It's a hard lesson to learn but by signing, you've accepted the truck as-is. I've bought many used cars over the years, got bit and learned along the way. Today, I go over them with a fine-toothed comb and either ask for items to be fixed/replaced or have them knock money off the price before I sign.... or just walk away.

    As for the dealer, if he has any reputation at all, he'd be better served to help out the OP and either make it right or compromise to something they can both agree to work with. It only helps him because word-of-mouth is half of any used car dealer's advertising. ;)

    Good luck, but I'm sorry to say that you signed off on the issues and realistically, they aren't required to do anything about it unless those tires are deemed unsafe for the road, then they have no choice (assuming they were the ones who provided what would now be an illegal inspection sticker).

    Here is what I got this morning from the local Toyota dealership I went to this morning for a second opinion to make sure the local garage wasn't just trying to upsell me for new tires.

    The 4 tires are the wrong size, they all have 5/32 tread left, and all 4 have dry rot cracking on the sidewall and they were manufactured in February of 2009. They advised me to go back to the dealership because any dealership with any reputation would remedy this, especially having the wrong size tires and the dry rot. Friends of mine all had good experiences with this dealership so I am hoping that this will work out in the end.

    Why would you give the dealer any grief about this? They bought the truck at auction with the tires on it most likely. Some of you including the OP are acting like they swapped the tires just to screw over the buyer and deserve to be punished.

    New dealers don't know all the facts on the cars they sell and they specialize in one brand. Now everyone is expecting a used dealer to know every detail about every make and model on their lots? The dealer probably didn't even know the tires were the incorrect size.

    OP I'm sure the "tire guy" probably said you got ripped off but I'm willing to bet he assumes you bought the truck brand new. Just buy the tires like you were going to in the first place and quit wasting the dealer's time.

    I wonder if the used dealer swapped out brand-new tires for old shitting ones they had in the back so they could sell the new ones? Then again it's possible someone who had the truck before the dealer did the same. Either way, someone stripped those tires to make a buck. OP said the truck was repo'd? Yeah, someone along the line removed the brand-new tires and slapped on some shitty ones!

    OP: I doubt you will get anything from the dealer, slimeballs as they often are. I'd do some research on tire sizes, figure out what you want, and go buy a new set. You will be very happy!

    I didn't see the part about inspection.

    Edit: I see you were planning to sell the wheels and tires. I thought you were just going to replace the tires.

    I know it sucks, but its a used car. Hopefully the dealer will work with you, but I doubt it.

    Buy some 265/75r16's and call it a learning experience. Was the truck certified?

    Ask for 5-6 free services and for free M&B on whatever tires you buy. Most dealerships will charge complimentary LOF's to thier advertising account and it doesn't affect the commissions already paid on the deal you did. If you approach them with a reasonable request and take some responsibilty for not noticing the tires they are more likely to work with you. Tell them that you would like to continue to do business with them and that your friends and family have had good dealings and you bought there because you expected the same.

    My 2012 Tacoma TRD does not have the SR5 badge. Although I believe earlier model 2nd gem TRD's did have the SR5 badge.
