    Guy, in case you haven't noticed, much blood has been shed in the name of a WHOLE lot of things (love, sex, opinion, greed, power, etc). As long as people are involved, religion certainly isn't going to be the lone exception.

    The difference is, religion is supposed to be about valuing life and creating and maintaining inner peace.

    But yes... human beings get involved and they pervert everything into something it was never intended to be.

    And, for the most part, it is. After all, at least where I live, I don't see a bunch of Christians or whatever rushing out of church on Sunday to devalue life, disturb the peace, shoot people, start wars, and/or so on.

    I guess I could have summed it up by saying they know what the law says and what they are allowed to do, and where the gray areas are. They aren't stupid or ignorant and they know exactly how far they can push. They are still within the boundaries of what courts have held o be free speech. They may encourage hostility, but they aren't saying anything that the extreme right wing conservatives haven't said, they just say it louder and and at wildly inappropriate times. The idea being gay is an abomination that God hates is hardly new, but when and where they say it is what gets under people's skin.

    The legal definition of malice though is very specific. There is no crime of "malice". Malice is only included in a charge when it done in connection with a criminal or civil wrong (e.g. murder with malicious intent, slander with malicious intent).

    a conscious, intentional wrongdoing either of a civil wrong like libel (false written statement about another) or a criminal act like assault or murder, with the intention of doing harm to the victim. This intention includes ill-will, hatred, or total disregard for the other's well-being. Often the mean nature of the act itself implies malice, without the party saying "I did it because I was mad at him, and I hated him," which would be express malice. Malice is an element in first degree murder. In a lawsuit for defamation (libel and slander) the existence of malice may increase the judgment to include general damages. Proof of malice is absolutely necessary for a "public figure" to win a lawsuit for defamation.
