    Okay I read through many of the posts.

    Here are more details. I rented the home for 7 years. The original homeowner/landlod passed away and the home was supposed to be assume by their daughter via estate/probate.

    The daughter was in fact awarded the home but unbeknownst to me at some point she stopped making payments. During this entire time I still made payments to her.

    The home was then taken back by the bank after it failed to sell at public auction. When the house was taken back (ownership) by the bank, the bank then contacted me (as a tenant) and opened up communication regarding staying in the house under terms of existing lease or vacating the property.

    I informed them my intent was to stay in the house under the current terms of the lease (which is a legal option) or to possibly purchase the home from the bank.

    Many different options were discussed and I was assured by the bank that we would keep in touch and work out a solution.

    A few days later the bank called and made me an unoffical offer of $5,000 to leave in 2 days. This was 2 days before Christmas and I had a house full of family, lights and 7 years worth of stuff.

    I declined their offer and reminded them that as a tenant I was entitled to a minimum of 90 days and possibly longer due to the remained of the lease.

    They assured me that was no problem.

    2 Days after Jan 1 a sheriffs deputy arrives and serves me with an "unlawful detainer" lawsuit.

    I was shocked.

    The lawsuit alledged many things and asked for many things including all attorney fees for Wells Fargo.

    I was more than willing to work with the bank and leave the house in a timely manner even before the time I was entitled to.

    Suing me was unethical and I think mean.

    I researched the law and went to court and the judge said simply "the tenant is entitled to 90 days in the property OR the remainder of their lease if they so choose".

    The judge admonished the banks lawyers for even bringing the suit since the law is so clear and asked me if I wanted to recoup MY attorney fees. I said no.
