From the different brewing forums I am either a member or lurker on; there is no legal distilling in the US. Period. I don't care how little or much you make; there is no legal distilling.

Ok; without a license it is illegal. I don't see Adam getting a distilling license.

True. I don't think Adam has that kind of money stashed up. But, without talking about illegal things, you don't need a license to make it. Or sell it. You just need a license to not go to jail for it.

Ok; I am a big whiskey drinker so I have been looking for all the loop holes since I started getting interested in brewing beer. All the beer forums I have seen have countless pages of ATF and the new agency links showing where the ACT of distilling for the purpose of drinking is illegal without a permit. The illegal part is the distilling without a permit. They will get you for tax evasion on the selling part.

    Oh

I thought it was in the same category as brewing beer. Thought tax evasion was then only illegal part. Apart of need some kind of license to sell alcohol

Nope. The difference in the eyes of the ATF and that new agency is the act of changing from one state to another. Beer stays a liquid the entire time; even hard cider. Whiskey goes from a liquid to a vapor to a liquid again; thus making it illegal. I agree it is stupid; but it is the law.

I brew beer; at no point is it a vapor that I collect and drink.

I really don't know what to do if this doesn't wrap up soon. I think next time I get someone on the phone I'm going to threaten legal action.
