I have a question. I'm new at this so I wanted to know how you go about "fighting" for a total. I have already contacted my insurance and they told me that I felt I was not being taken care of to call them and they would step in. I have all of the information on just what my truck is worth, options, etc. However, how do you make an insurance company total the truck if they do not want to? It's me that's is without a vehicle in a line of work where I drive 5 days per week. I have done my research and have all of the information on my vehicle, options and stuff, that prove what it is or was worth, but I'm just confused on what exactly I do if they bring me an offer I don't like (besides just refuse and say no).

I would do my best to make sure it is totaled and would pick up a new one and start over again.

Glad someone agrees! Especially if you were doing something for work... A. Make sure you get a new truck, B. make work give you a company car from now on. The way I see it, they don't pay for your insurance or your truck payment. Until they contribute, don't use it for them!!!

My father in law looked at it. He's been rebuilding cars for 40 yrs. He says it appears the frame may be twisted also since e back is off-center now, so that may change things but ill have to wait until Monday at least.

$0.55/mile for company use of a personal vehicle, I'll put 50k a year on my truck (and did for almost 10 years)

They didn't total it. I'm having it repaired but fighting with them over diminished value. I've already been stubborn enough to get them to authorize $1500 in DOV before repairing it. Right now I'm getting written quotes from dealers on pre and post crash values. I'm giving them to my insurance and we are going to get as much in DOVoney as is possible.

I would push for a new truck talk to your insurance agent I went through this with my mothers crv she got hit on the side and wanted to fix it I called our agent and he talked to the other insurance company he got us 17500 which is about 2000 more then her crv was worth. The best part was I did t have to be "that guy" I just was straight up with my State Farm agent the other persons insurance was Allstate her door and rear quarter panel were banged up and the wheel was pushed in a little all bags went off he was telling me just the bags and sensors can cost upwards of 5k it was unibody with slight damage... I would really push to have it totaled or a new frame

I've pushed as much as I can. You're not going to force an insurance co to total a truck if the damage isn't there. Mine was 7600. My. 7 month old tacoma is worth 27000. No pushing is going to make that truck more to repair than its worth. I have spoken with an attorney. I can't afford spending thousands to try and litigate something I'm likely to lose.

How does one "push" for a new truck when the damage does not warrant totaling just because it looks bad. This was a 2012 truck and would have needed damage over 18k or so to total. One could install a new frame and repair the other damage for much less.

To OP, good luck and don't worry, your truck will be good as new.

How will a lawyer help when the mechanical damage can be repaired for much less than a total. The insurance company will then sue you and your attorney for triple their fees and you will lose.

    Take care!

I was in an accident last month that resulted in 15k worth of damage. My rear shackle was kind of bent because of the way i was hit, but they fixed it. My insurance had to cover all repairs because the person who hit me didn't have any so i had a million questions for them about every little thing. The main questions at first was if it will be totaled and they told me as long as the total price of repair doesn't go over 80% of what the vehicle is worth it will not be totaled. They appraised it at 26k. A lot of people don't know what they are talking about when it comes to getting the insurance companies to consider vehicle damage totaled.

The frame can be straightened, just make sure its a reputable shop, and try to check in with them after the frame is pulled to make sure your happy with it.

OP, don't let it get to you man i was the same way. It sucks big time at first, but when you get it back it feels good.
