    wait how did the plates match:confused:

    the plates matched the person who committed the crime? Unless brad was the suspect in the crime when they ran his plate they would see he has nothing to do with the suspect they were on the look out for.

    I'm not going to speculate on the story the cops have, because I don't even know what it is.

    All I know is, we were not charged with any crime, and were given answers very late into the ordeal. We have injuries to our wrists and were not taken care of while in custody of the police officers even after requesting assistance multiple times. Then it was all over like "hey, sorry bud...our fault...but hey, we're still taking the truck. my bad."

    I'm going to exercise any right I have with this, because although they followed procedure in the felony stop, the events that took place after we were in their custody do not sit right with me. It's my choice to seek legal counsel.

    The plates and vehicle description were an exact match to the eyewitness of the crime in question. But my rationale says that the eyewitness gave a false description, or didn't have the facts straight. It's possible Brad was there during the crime, simply in the wrong place at the wrong time.

    By all means talk to a lawyer, I'm pretty sure there isn't a whole lot he could do, but seizing the truck is another issue.

    I think this is your best course of action.

    He/she will hopefully know, given the local court system, if the treatment you guys received would likely be considered a violation of your rights.

    As I'm reading it, it doesn't sound like LE did anything wrong, although I'm wondering what took so long. There may be a legitimate answer to that question.

    Assuming the three involved and the truck had nothing to do with the crime, there should be no expense to any of you for the truck being towed or stored, but they may say tough luck. If there are charges, I wouldn't hesitate to make an issue of them.

    Could have been a form your fingerprints went on, but you should know what you signed. I know it was stressful, but if you weren't explained what it was you were signing, you should have been able to read it.

    Just because they weren't charged doesn't mean it wasn't an arrest. Being detained can become an arrest in a legal sense of the word. When that happens would be left to the determination of the court system. It all depends on the length of time, the seriousness of the crime, consent--a totality of the circumstances.

    I don't believe they had the exact plates or they would have gone to the owner's house. It appears they were pretty close or matched whatever partial plate they were given.

    It was a 100% match. The supervisor told me so, and said the vehicle description matched exactly. Silver truck with camper shell. And I also don't understand why they didn't come knocking on his door months ago about it. He lives 1 block from the police station and the family knows many of the FVPD.

    When I was in the car being detained (the first cruiser on scene that was following us from the beginning), the screen in the car had a picture of the Brad's plate with big red bold CAPS above it saying "FELONY MATCH EXACT" or something along those lines...which had me worried for a bit about who my friends are, but when I realized Brad consented to the search I knew there was no foul play.

    I think they LEs knew what they had within fifteen minutes of running them, they had nothing, so why take the truck and not bring anyone in for at the very least DOJ checks? It doesn't make any damn sense. They had nothing, they knew that within fifteen minutes.

    Hold on wait. Okay so the three of them are clear, we know that. But even though the truck was not lent out to anyone by the registered owner, the vehicle may have still been used? We were at a gathering with a bunch of families. My son happened to bring his new car. His buddy asked if he can have the keys so a bunch of them could go check it out.

    As my husband and I were leaving the gathering to go home, I see that my son's car is gone. The guys took his car for a spin without his permission!

    Okay granted thats far fetched, but my point is, is that perhaps for a short time it was used in the past?

    Or as stated before, the security guard just grabbed a random truck and said "It was him!!"

    they dont have to read you miranda rights since there was no interrogation. they acted on the information they had, and didnt do anything wrong. wrong place at the wrong time for brad i guess.. it happens. if youre honest with them, and dont act like a roadside attorney - kind of like you do sometimes in this forum - then things will go 100% better for you. if youre a dick, and act like gods gift to supreme court rulings and the constitution, consider this a slow miserable process. the prints and photos were to go with the investigation. no you should not be paid for this, no you should be paid for a rental car, and brad may end up paying a tow bill/impound fees depending on what happened, why he was there, and if he had anything to do with it.

    The crime was committed 45 minutes distance from Brad's house...nobody took the truck. He would have known if it were taken without permission.

    I'm leaning more towards the security guard freaking out and giving a falsified report.

    As soon as the cuffs went on, the question should have been asked "Why am I being detained" (because obviously, at that point, the answer is clear to "Am I being detained or am I free to go?).

    They were told why they were being detained, and as much of a PITA as it was, an hour is not totally unreasonable.

    What is unreasonable is Brad having his truck impounded without being charged, and the detective being "on vacation" and unable to clear the truck (he works alone?), but that's for Brad to deal with.

    I didn't ask for my lawyer, I was completely honest and respectful to the LEO's and even thanked each one of them and understood they were just doing their job. I didn't know my hands were going to swell up the next day and be so bruised, and I didn't know they were going to take his truck without giving him any information on the crime because "the detective was on vacation".

    Again, put yourself in mine and Brad's position bro.

    I didn't read the last 2 pages of this thread, but from the comments I did read, people seem to be nit picking at things they think were done in violation of your civil rights based on things they probably "heard from a friend" or "saw in a movie". Nothing was done wrong.

    Officers had reasonable suspicion and plenty of probable cause to make a felony stop. You were removed at gunpoint and detained harshly because you were probably considered armed and dangerous and wanted felons for all they knew.

    You were not mirandized because you were not under arrest, only detained. It was a legal detention due to the nature of the investigation.

    The cuffs were too tight.... oh well, too bad. It happens.

    You signed something you couldn't read.... too bad, you should have asked for more light or a copy or refused to sign until it was explained.

    Car was impounded for further investigation.... legal. Plenty of probable cause.

    Nothing is wrong with this situation other than it ruined your night.
