    Civil case against whoever filed the report.

    You will have to prove that they did so maliciously and it was not a honest mistake.
    Not needed if they were not questioned. Seems the only question asked was "Do you want to know what's up?"

    i am putting myself in brads situation, i wouldve told them i had nothing to do with it, let them take the truck, and wait for everything to be cleared. the whole cuff thing really cant be complained about, thats part of being detained, and they have no legal obligation to make you comfortable. sicking an attorney on the cops isnt going to get you anywhere if none of you really had anything to do with it. the truck may be gone until the investigation's over, thats part of being in the wrong place at the wrong time.

    Was a bad weekend for my friends and family with LE. My brother's car was searched based on a hunch that him and his friends were searching other people's cars on his street...they were outside smoking a cigarette.

    And my friend was stopped at a DUI checkpoint and her car was impounded because the officer's thought she was not in the condition to drive, although she blew < .08 BAC.

    All happened yesterday LOL

    you can still be DUI under a 0.08, there are MANY standardized tests, the same from state to state that are conducted to show impairment fyi. and another case of being in the wrong place at the wrong time.

    I am not going to comment on other members posts Matt. I just want to acknowlege that you have experienced something I hope I never do.

    What is clear to me that we live in crazy f'd up world and unfortunately innocent people sometimes trip into it. The shit you had to experience was unwarranted. It is dissapointing that the cops involved in the process treated you as poorly as they did. Especially considering that you all cooperated and have clean records. They had every reason to treat you as respectfully as possible during the procedure. Clearly they failed. Ultimately it is events like this that give cops a bad reputation among the population.

    All said, the cops you dealt with are just people doing their jobs. People fuck up all of the time. The individuals responsible for the comfort of the three of you during this process should be reprimanded. They need to learn to do their jobs better IMO. Cops are servants of the people, i.e. you and your friends. They should be forced to answer to the people if they fuck up. While fileing a complaint in the department will likely accomplish little and get you mired in beurocracy, doing so in conjunction with getting your story published in print may be more helpful. I dont know this for sure, but it is something to consider.

    Sorry you guys had to go through this. Its lame, and I appreciate how you feel. It sucks.

    That is complete nonsense, why would brad have to pay any sort of fee for his truck being towed? How does "wrong place wrong time" mean that getting towed is acceptable and should then be billed to the owner of the vehicle.










    also, sorry for fail reading. didnt realize that the plate were an exact/near exact match. Don't get how that can happen unless the match parameters are super broad or someone gave the wrong numbers. Sucks bad.

    oh you're funny! For everyone else, go scroll back a couple of pages on the Funny pics thread, I got stopped for speeding after a TW meet with Chris 4x4, his wife Julie and Rardrigo, Chris offered the cop $20 if he would draw his weapon on me and let him take a pic, either way Chris just had to get a pic of the merriment. They were goofing off, wasn't to terribly amusing to me but I take things in stride:rolleyes:

    Just to be clear, I did in fact ask if I was being detained or arrested and for what reason, as they were cuffing me. The LEO that was handling me was the one that was first on scene, and he seemed disgruntled. He told me, "you're being detained because the truck was used in a crime in 2012".

    I did not expect to hear miranda rights...I knew the difference between arrest and detainment. I just didn't think it would be 1 hour and a half before we even knew WTF was going on.

    Oh sorry, I forgot you were there and know all the details... anyway

    We could all go on and on all day about it, we don't know what happened and what exactly was said and I'm sure if we talked to the LEO's that were on scene their story would be different than from the story we are getting here.
