Need some advice on filing a dispute

    The company isn't a vendor on here that i know of, but i heard good things about them so i don't want to put his name out there as of yet.

    Purchased an item for the Tacoma back in March from the companies website for $543, There was nothing there mentioning the part was made per order, but i did notice it said available in 14 days. After the order was submitted and the money taken out of my acct i emailed them asking what type of time frame i should be expecting. I received a reply within 24hrs telling me that it shouldn't be more than 3-4 weeks. Exactly a month later I emailed them again asking for an update and i get a reply saying they had to re design the bracket and that they were waiting on some parts. I replied to them asking about some concerns i had about the design a member on this forum had with installing the piece, but i never got a reply. Now we are in June and i emailed them again, and it has been a few day without any reply. I paid them through their website with Paypal and i tried to open a dispute, but Paypal rejected it because it has been over 45 days. I'm now wondering if i should try going through my bank or wait to get in contact with them. What would you guys do ?

    Have you tried getting them on the phone?

    Usually prefer email over voice, reply on my time and a "paper" trail, but sometimes the phone is the best bet.

    I had this happen years ago and I contacted my bank. They attempted to contact the vender and got no reply due to the company going under. Long story short the bank gave me my $ back and continued to pursue the vender. Not sure what happened. I stopped worrying after my refund. If u bank with a major bank I'd try this. Local bank I'm not sure about. Good luck.

    I have just been going through email. I tend to prefer the paper trail, but i'm going to be giving them a call before heading to my bank.

    The only thing i can really think of is going directly though my bank. Hope they can help me out since its been over 2 months already.

    So, I tried calling the company yesterday and didn't get an answer. Went to the bank this morning before heading to work and i asked them about opening a dispute and they told me by law anything over 60 days can not be opened and continued to tell me this type of stuff happens to people all the time that don't know you have only 60 days through a bank, and i found out Paypal is only 45 days. Now I am getting kind of worried here about my $543. Going to try calling them back again today, hopefully someone picks up.

    Lesson learned, if anyone is ever getting something made for their truck or anything in general never let it go over 60 days unless your trust that person/company.

    I'm not sure why the bank did that as the bank has no recourse and is unrelated to the transaction (as far as recourse goes). Only Paypal can address it, and sadly their policies are creating a problem. That's why I prefer to use a credit card, or in the future will monitor issues like this with paypal so if it gets close to the 45 days, will open a case.

    If I were you I'd call Paypal and plead me case, if that doesn't work, it certainly doesn't hurt to try calling your bank (was the money pulled from the bank or against a credit card via paypal - IF it's against a credit card you could probably go through the credit card company). After that, I'd put a formal request in for a refund (in writing) and cancellation of your order due to the promise that it would be delivered in X number of days. If they don't respond, tell them you're filing a claim in small claims court (if they're out of state or a long ways off they have to travel all that way to defend themselves - if they're going to - and may just decide it's less hassle to give you the money back. gl!

    And before naming names, tell them you're going to spread this story over any and every Tacoma/etc. forum on the internet, Yelp, BBB, attorney general, etc. and will go out of your way to ensure that everyone knows how dishonest they are UNLESS they refund your money or send the product immediately. (use it as leverage)

    Budbuilt and the item was their Traction bar. Just called them back again and left a message maybe they will call back :notsure:

    They money was pulled from my credit card "Suntrust Bank" that is attached to my paypal account. I always figured doing it that way instead of a paypal credit card would give me double the protection, but guess that didn't work at all. I'm going to give them the rest of the day to see if i get a call back.

    Wait, when using paypal, one typically uses a linked credit card/bank account. In that case, the bank can be help since that method is used. Paypal, is well...enough said!

    Send them an email today as well (it's in writing) - lay out what you want. The sooner you do that, the sooner you can move to the next step (IF it comes to that). Start the clock ticking now. Just lay it out, firmly but professionally -

    1. You said you'd do X in Y days, it's been...
    2. I've contacted you on these days... you said x, it didn't happen
    3. You are requesting ____ (money back? product within X days or a refund)
    4. Your lawyer (ya, I know you don't have one - they don't however) has advised you to file a claim in court for a refund is #3 isn't done, and you'd rather not have to do so (again, always start nice, but firm)

    you could mention the social networking part... but i'd think about waiting until the next stage - where you get a little less nice... :D

    when I PayPal, I always use my Amex gold CC for payment or my PayPal credit, had disputes like this before and always got me $$ back, Paypal and Ebay claims suck, they make it so hard and they drag their feet, dang crooks have left town by the time they around to anything...a total joke..easily solved with call to AMEX...

    CC protects you.....sorry to hear you got screwed...

    Maybe someone from the company will read this and finally respond....
