    From previous discussion with my insurance when my wife was involved in a little fender bender, parking lot accidents when both are backing out is usually a case where each driver is at fault and each have their own insurance fix their vehicles. Most insurance companies will also not make your rates go up for this. And also, as mentioned above, if the other party is working through their insurance, you will have to do the same, or you will get screwed. At least let your insurance fight for you instead of just having the other party's fight for them.
    In today's age with everyone having cell phone cameras, always get pictures...

    In a civil setting, (which is what an accident on private property is considered in most states) usually a determination is made to assign a percentage of liability. Liability can be assumed 100% by one party or split between multiple parties. In a 50/50 accident, such as the one you describe, usually your insurance company would cover your damages and her insurance would cover hers. If you did not call your insurance company to report the accident and give all the info of the accident to them, that was your first mistake. If you haven't done so still, that's your 2nd. Call your insurance company. Pictures can be altered, damage can be fixed and altered, and numbers can most certainly be exaggerated. She probably called her insurance company right away and said "OMG this guy just hit ME...blah blah blah" People lie.

    No the guy said i was at fault because she had sideswap damage and i had a direct impact dent. So il just mod my truck and make my own claim.

    Im proving a point, She could the exact kind of thing, No pictures at the scene but pictures taken a week later. Thats more then enough to alter the damage... There is NO proof we even hit eachother besides a piece of paper with my info on it... How can this not be a no fault case??

    It sounds like you're saying they misrepresented the damage based on this ^...

    I spent $250 recently to have a bumper cover resprayed because it had a ~1.5" paint chip where I'd backed the car into a rail in a parking garage at low speed (no other damage). That's with me removing the bumper cover, stripping it down and re-installing it myself. $850 doesn't sound that bad to repair and repaint a quarter panel. Factor in labor for the repair, shop materials, time spent masking off the rest of the car, then the paint and I can easily see $850.

    I wouldn't assume they must've misrepresented the damage to the car. And I CERTAINLY wouldn't consider misrepresenting the damage to yours. That's a good way to end up with legal trouble.

    My son was backed into a couple of years ago. They called my insurance co and put in a claim. I told my insurance not to pay, since it was the other guys fault. They gave us bogus insurance info so I couldn't file a claim with his insurance. They finally did a phone statement from both my son and the other guy and the other guy finally admitted he saw my son and backed anyway :facepalm: We had rear quarter panel damage. Old guy bullied my 16 yo son, but in the end, he had to pay for his own damage.

    If you haven't called your insurance company, you need to DO IT NOW!!!! Let them work it out.

    with that being said, i HIGHLY suggest you change your mind about committing insurance fraud "to prove a point"

    theres been at least 1 other person here who tried that...it doesnt end well

    You are both at fault. This is called contributory negligence. It is a tort. Look it up. Yes, I took a law class. Fight this if the insurance company is trying to pin this on you at a 100% level. I hope this helps and good luck!!
