That ain't no friend. A real friend would be bent over backwards to get that money back ASAP.

 

Or at least return the car if he can't pay for it, which he says he can't do..mind you he can't drive as of Aug 1st b/c he didn't renew the reg on it.

 

That sucks! Hopefully he pays you back soon.

 

With no job and his constant bar hopping IDK how..sent him a certified letter this week from the wife telling him pay it or return it by Friday. If that doesn't do it, I'll file it in court Monday.

 

I hope that's enough of a kick in the butt, but I think unless you guys drew up a written sales agreement which shows he has been negligent in payment you may not have a legal leg to stand on.

 

This is why I don't lend more than I'm willing to give...

He's admitted the loan in general as well as owing the $800 in text messages, all of which I saved, backed up, and printed..so the proof is the easy part.

They may honor a verbal agreement with some evidence. I normally don't sell any big ticket items without a bill of sale.

 

With a verbal contract, courts will decide themselves what is reasonable given the circumstances of the case. Chris will win in court, I just don't think it's worth the time or money, as even the courts can't get you your money back if the other guy doesn't pay. It's an expensive lesson learned, but I wouldn't tie up any more money into the issue.

Yes. Dislocated it once when I was in high school. Sprained it a buncha times after that. Dislocated it again on a 12-mile ruck march. Sprained it countless times since then. Ice, Ice, Ice. Motrin for the swelling.

 

Yup! I've got 2 sets. I have a chrome set without heat and the black set with heat that is on my truck now. I also have a seperate set of just the mirror glass with heat.

 

Mentally noted. My wife would kill me if I bought a set right now.

 

Verbal initially..I have the copy of the check I gave my brother in law as payment. He admitted the loan to me, my wife, my brother in law, his brother, etc..and I have text messages of him doing the same.

MA small claims allows you to sue for specific performance as well, IE pay the money or return the car. For the $40 filing fee I'd be silly not to do it.
