Small claims court in MA..a little help please..

    I'm contemplating suing GM. Short version, my head in my old truck died and was under a warranty due to them having issues with them. The dealer who certified it as being eligible then refused to fix it 4 weeks later. The dealer who did the work charged me almost $2000 for all the other things the head broke and told me GM will take care of it. They did not, and told me to call the dealer. The past year has been spent dealing with this cluster where each one says the other did it.

    Anyhow..

    I've used small claims before so I know the general process. Being that I'm suing a business who is headquartered out of MA, what do I need to do above and beyond the norm (if anything)?

    I had a similar issue with my previous car and after getting nowhere with the dealer and corporate, I finally called corporate one more time to ask for a refund. They stated 'no' and told me that all repair bills were justified. Anywho, I finally told them that the next call they were getting was going to be from the Attorney General, followed up by a lawsuit from my lawyer for stealing my money and refusing to honor their warranty. The lady on the phone put me on hold for about 10 minutes, and came back in a defeated tone saying that there were going to mail me out a $2,000 check the next day.

    Have you threatened letting the A.G. know what is going on? Let them know that you are done dealing with their nonsense and the next person to speak with them over this issue is going to be your lawyer (spend a few 100 to have them draft up a nicely worded letter asking for a refund if needed).

    I have. The AG referred it out to a consumer protection agency who got the same pack of lies that I got. Said agency, while being very nice in my dealings with them, admitted that they have no real power to influence the decision.

    For the $50 filing fee in small claims, I figure if they want to send someone from corporate up to deal with it at their expense let em..win either way in my book.

    Don't know man. But, was the subject vehicle produced and sold pre or post bankruptcy? If it was pre have you done any research in terms of what impact that may have on government motors honoring their word?

    I'll be interested in knowing the steps and outcome for you.

    I bought it in June 07. The issue all happened in Jun/July 12.

    Google "Chevy Colorado head", the heads were croaking in no time on them and they did an ext. warranty on the head. When mine went it ate the cam and timing chain.

    I've been lied to a lot, between the dealer not knowing about the warranty, then refusing to fix it, then telling me GM pays me back for the other parts and that he can't do it..I could write a book.
