low milage new car

two months ago i was sold my tacoma with 23 miles on it as new. today i saw adealership selling one with 23 miles on it as used? whats the criteria for a car to be sold as new

 

Not having been registered before.

 

Buyer would be first owner.

I know that recently I went car shopping with my family and saw lots of "used" vehicles with under 40-50 miles. The dealership explanation was that these vehicles were purchased from another dealership and could not be labelled as "new" because of that. I'm not sure how much truth there is to that, but several dealerships said that.
