Thank goodness at least that where it's a company vehicle, there's little chance it wasn't insured as if it was a personal vehicle. Be nice if the company even helps out just to keep it quiet.

And yes, drunk drivers infuriate me. I made that mistake too damn many times in my younger years, fortunately nothing like this happened but it could have. Reasons like this are why I not only don't touch the stuff anymore, but am the first one to pick people up or drive them home if they are bending the elbow. Not worth risking other people's lives and property.

The company will be able to claim gross negligence, and support that with the termination.

But their insurance will likely pay and they will attempt to recover from their former employee.

That's bs he shouldn't have but he did, they have to take these sort of things into consideration. If he had stolen the van then I would understand how they wouldn't cover but it is their van with a legit former employee.

    Shitty deal.

What he should or shouldn't have been doing isn't the problem, what he was doing is the problem.

Will the police choose not to charge him with DUI because he SHOULDN'T have been driving at the time?

I can only imagine how pissed you are...I know I would be.

Can they do that? I assumed they were obligated to pay, but I've never messed with a "company" vehicle. Sorry man!

I assume your insurance is involved. Contact, or get a lawyer and have them contact your car insurance and your homeowners insurance because they will also be trying to say they are not responsible. The person who is not responsible is you.

If it makes you feel any better (I know it won't) that company just got fined $54,000 yesterday for alleged violations.

I am sorry to hear about your truck, and especially with where it occurred at your house. Just hope that the asshole driving drunk doesn't have some sort of "in" with the Cops/township where this occurred, with it occurring in NJ (this state)... It could have been some derelict piece of shit who doesn't contribute anything but more public debt to society, and if he somehow 'knows' someone who runs the town, the kid cops that are assigned to something like this at night could be directed to change their written record. I suggest to confirm their story both tonight and tomorrow morning, just in case, and complain like a bitch if the details don't match.

I'm glad that no one innocent was injured.

Yea my insurance will be getting involved now, worried about rate going up tho, broke college kid every penny counts. Lawyer is also a ready option and I believe they wouldnt have a problem tearing this up but i really dont want this to drag out forever.

So was the driver insured or the vehicle. I'm betting that the company will end up paying in the end. Your insurence should do what needs done and then persue his (company or him). Either way, it sucks.

Luckily my old man is pretty good friends with a bunch of them. I dont think they know him. He ended up blowing under legal limit at the station, but they still charged him with DUI. The leutenient told me that for his sake he may be able to plea down to a reckless driving because he was under, but they did write in the report "Driver #1 had an odor of alcoholic beverage emanating from his breath which contributed to the crash". The DUI stuff shouldnt make any difference on this situation though.

    .
Your rates shouldn't go up kid, it wasn't your fault, hell you weren't even in the truck. Your ins should be going after theirs because your ins is not gonna want to buy you a new truck.

It sucks that it happened... but now one less moron on the street. Im sorry your truck had to take the hit, if it makes sense...

every street parker's worse nightmare. sorry man! hope everything goes smoothly (and you enjoy your new 2014, haha). had some stupid chick (completely sober) almost total my car and hit 2 others while it was parked at my apartment. luckily, her insurance covered the repairs AND my rental. sad part was she hit our cars with her moms car because her car was still in the shop from another accident. the dmv needs to realize not EVERYONE needs to be allowed to have a license and i agree drunk driving should be borderline felony because the things that CAN happen from drunk driving are worth far more than a slap on the wrist.

Even if his company's insurance refused to pay for it, which kind of makes sense since he wasn't on the clock, his own personal insurance should cover it. Did he only give you his company insurance information?
