Parked taco just got destroyed by drunk...

    The other guys insurance can deny the claim if the policy is written to exclude losses while not working or on the clock. You would then sue the pants off of the company and/or employee.
    I would definitely now have your ins company involved. They should see it thru one way or the other. Key word being SHOULD.
    Too bad but the other ins company is denying coverage based upon the rules of the policy. I'm sorry but I don't hate on the ins company in this situation because the employer could have extended coverage for their employees during nights and weekends, but chose not too.

    TRUE. If the primary coverage, being the employers policy, denies coverage, than dudes personal policy might apply. Some policies are more restrictive, but if this dousche has any prior duis, he might only have a ghetto policy that is super restrictive and might also deny the claim based upon he was not driving the insured car listed on the policy...another way ins companies can fuck with you, but in their minds they're limiting risk, aka $

    Sucks but it sounds like you're about to find out just how good your insurance company is. If the other company denied it they should be settling with you and going after the other company with their lawyers. That's what you pay them for.

    I doubt he has had prior DUIs as people with DUIs don't usually get hired as drivers but I may be wrong or maybe he took it out even though he is not a company driver.

    BS. Your insurance should be going after this guy. I can see where the company may have a claim as when I drove a company car I was required to carry insurance on it myself and the company re imbursed me. Not all companies are alike. I'm sure the company in question will not want media involved so you could always take that option. But your insurance should be handling this and telling you to start looking for a new truck.

    Not necessarily. From my professional experience, they can get hired as a driver as long as their driving history does not show a conviction for the DWI. At least here most of the DWI's are plead out to lesser charges and do not go on their driving record as convictions.

    Asking/promoting zero tolerance is plain stupid and only for the ill and uninformed, mostly called for by people that can not think rationally for themselves.. Zero tolerance gets 6 yr old kids charged with sexual harassment at school for kissing the hand of a girl (Colorado last week). Zero tolerance gets kids suspended when they eat a pop tart into the shape of the state of Florida or a god-forbidden gun. Canada, zero tolerance allowed the police to raid a home, strip search and arrest Jessie Sansone after his 4 year old daughter drew a picture of daddy with a gun in kindergarten.. The gun depicted in the drawing wasn't a real gun, it was a toy gun.... Zero tolerance allows brain-dead administrators to keep jobs they have no business holding and removes common sense from every situation. Be careful what you ask for, you will have to live with the consequences.


    Holding people responsible for their criminal actions works, zero tolerance does not. There isn't anyone who hasn't had a beer or glass of wine with dinner and driven. Just what we need to fill our jails with everyone having a beer with their Mexican food dinner....


    At this writing, Just a few threads down on the forum page is a guy that mounted a Guinness bottle opener in the bed of his Taco,... Zero tolerance, heck just pick him up and throw him in jail for thinking of having a beer.....

    Zero tolerance means I can't send my daughter to school with a plastic butter knife in her lunch. I can't send her to school with one dose of Tylenol when she has "female problems".

    Each party pays for his/her own damages regardless of who is at fault. There is probably more to it than this but I think that is basically what it is.

    There does need to be much harsher punishments for it countrywide.

    Holding people responsible????.............Does not work. I see this at work all the time. I went to court last month for a guy who we arrested for DWI after running his car into a house. Little bit of history for you, and some facts, DWI in NM is a misdemeanor and only becomes a felony when it is your 4th conviction!! After your 1st conviction or even if it was plead down to a lesser charge and your license is still revoked we can seize your car unless you have an ignition interlock installed in your car. So back to this guy last week, when we ran his history it showed that he had 1 prior conviction on his record, so we seized his car. Come court time we find out that it was his 16th DWI related arrest and that the department that I work for has seized 12 cars from him. Every time that he gets arrested and it goes to court it gets plead down to a lesser charge and he is given another chance banking on the fact that he is now being responsible and he has been doing his community service that was required from the last arrest.

    When does the holding people responsible part start?

    What you referenced is a judicial problem and not a zero tolerance issue. Prosecutors and judges turning repeat offenders loose isn't a problem unique to Albq. Obviously this guy isn't just having a beer at Sadie's with his dinner and driving home.




    Side note: you guys are under a lot of pressure, even this summer after that incident up by Manzano war was declared on all of you and most recently the nutjob at the bus stop who had the car washer call 9 11.... Be careful man!!
