    We had a kid do that back in high school. Stole his dads truck and wrecked it in my yard. Parents said he had "some issues"

    no fault insurance means that no matter what the circumstances are leading up to a wreck all of the parties involved share the blame equally. For instance: say you were stopped at a red light and someone rear ends you and pushes you into another vehicle. in a no fault state all 3 people and all 3 insurances pay for the damages. in an at fault state the 1 person (and their insurance) that rearended you would pay for all 3 vehicles.

    People who are saying capital punishment for DUI... Wow.

    I'm sure everyone here knows someone who has gotten a DUI, and would agree that not all of them deserve to die, because they got pulled over and blew a .08. That's ridiculous.

    Zero tolerance is also just not a feasible option. Anyone who took a dose of DayQuil or drank a half a glass of wine would then be subject to prosecution (and in the opinion of some people in this thread, the death penalty).

    Common sense and moderation seem to be lost on so many...

    I agree. I don't think the difference in a .079 and a .081 makes you drastically different in your ability to operate a vehicle. However, when you start having people blowing double and triple the legal limit those are serous dangers to society. I think a .081 should be prosecuted a lot differently than a .24

    Clearly people can't handle drinking and driving. Take it away. A drink and you give up your privilege to drive. Then maybe people will start taking it seriously.

    Sounds like the people that like to drink and drive are defending it. Sooner it later you'll be affected negatively by a drunk driver. Maybe you'll change your mind then. Until then, you are being ignorant.

    No, Massachusetts insurance assigns blame in an accident, it is not "no fault". If you rear end someone, you are assumed to be more than 51% at fault for causing the accident. If you are drunk and have an accident, you are at fault. One can appeal the inevitable surcharge through the merit rating board appeals process.

    If you are friendly with your insurance agent, ask them for a copy of the "standards of fault" list. It will tell you just about who is at fault in what type of accident.

    If the OP lived in Mass., his insurance company would get involved and make him whole in this accident ASAP, then would sue the drunk's insurance company to get paid back.

    Filed a claim with my ins. Yesterday so their gonna reappraise the truck and go from there. Just dropped off the vehicle release form to the towing yard so they can relocate it to their insurance yard. So well see what happens. Now I gotta worry about them totaling it again lol. I got to see it in daylight and the body is almost completely torn from the body mounts:eek:

    Wow, glad nobody was injured but it's inexcuseable that the guy responsible was driving drunk. I'm sorry for your vehicle & could not imagine being in that situation myself being woke up in the early a.m. to find my truck destroyed. Glad I have mine in the driveway! Hope the insurance takes care of ya!

    I'm a paramedic. I don't drink and drive, period. I've spent more money on cabs than I would like to admit. I've got a childhood friend in prison and a buddy from high school in the ground along with another passenger in the car being driven the former. I've got another friend who's funeral I attended last year because he was too stubborn to let someone else drive and ejected himself 200 ft from his vehicle.

    I've seen the shit at work and I've been affected by drunk driving. I'm not defending drunk driving, and I'm not being ignorant. It would be expensive, irresponsible, and not feasible to create a zero tolerance law, let alone seriously believe that capital punishment is an accetable punishment for blowing over .08.

    I'm all for harsher punishments for DUI's (jail time, probation, driving restrictions, ignition interlock) as well as proactive prevention like creating server (restaurant/bar/homeowner) responsibilty, dui checkpoints, ect. It's been pretty well proven over time, that over regulation, zero tolerance, and prohibition type laws have a track record of doing nothing but creating a culture of dissent and not actually curbing crime. There needs to be more common sense, and personal responsibility/moderation, not more expensive and unenforceable laws.


    Edit: Sorry to detract from the original thread, it's awful about your truck and I hope your insurance goes to bat for you and takes care of the new truck quickly. Thank god nobody was injured.

    It's no secret that the reason getting a DUI conviction is near impossible is because of state legislatures. A good many senators/representatives at the state and national levels are or were lawyers.

    In my state, one cannot testify to the reading of a breathalyzer or use the horizontal gaze nystagmus test as proof that a drunk is in fact, drunk. Lawyers like to use fancy words to discredit the machine and the tests, so that no jury ever gets to hear the numbers. Do you really think when they go back to private practice, they are going to want a hand in making their job harder?

    I haven't read all of what's been happening in your ordeal.. But if it were me I would be adamantly letting my ins know I wanted it totaled.. It wasn't your fault and you shouldn't have to drive around a truck that got smashed because of a dumb ass drunk driver. Tell them you wouldn't be happy with it or safe after seeing the damages etc. Don't forget you pay them.

    As of May 2013, The National Transportation Safety Board is now recommending that all 50 states lower the limit from .08 to .05 for DUIs. Of course when the feds 'recommend' something its only a matter of time before they with hold highway transportation dollars and force their recommendation upon us/states. Wont be long then they will be recommending .03, then .01 then just looking at a beer with dinner will get one arrested..

    good point, i did stress this fact to them. No way I bought a truck this new to have it be a reconstructed pile o chit, thats why i sold my old jeep in the first place.

    Yea i love the timberland mica but i don't think green is my color. Flashback to 2010 Heres my first car(jeep) after a jackass in an awd exploder thought he was better than the snow and could do 55 down an icy road. Slid into my lane and whacked me head on.

    This statement alone cost you credibility.

    I don't drink and drive EVER and I have been effected severely by drinking drivers. Zero tolerance or taking a persons license will NOT stop the from driving. Passing more and unreasonable laws is not the answer.

    And BTW, I don't consider myself or the few others on here who DON'T AGREE WITH YOUR OPINION ignorant.
