    Wait, by that notion if he had a gun and was shooting people he would have been charged and treated the same way?

    4 people lost their lives.

    No I was saying that he doesnt care about what happened because he has never had to care about consequences. To him it doesnt matter what happens because he is more important than anyone else. Hence, why he feels like he can do what he wants. IMHO he should be charged with 4 counts of murder.

    Actually afflenza means that BECAUSE he comes from an affluent family, he does not know the difference between right and wrong, but in a nutshell, yes, you are right.

    Here is my opinion: I know a lot of people who are rich. I knew a lot of people in Texas who were filthy rich. The kids still KNEW right from wrong, they just didn't CARE because they figured their rich parents could pay off lawyers. So I don't buy the bullshit that he didn't know the difference. The kid KNEW, he just didn't CARE, and in my opinion, THAT is not a legal defense. We have cold blooded murderers that kill and get the insanity plea. Even THEY still go to a mental prison. When you read all of the information here, the only reason this kid gets to go to this "country club" in California is because his dad is footing the bill. Here is the problem as well. The parents are SUPPORTING the kid's belief that he is free to do what he wants. They are using their money to keep their son from prison. Yep, the kid is REALLY going to learn consequences at that "rehab" center.

    Either way, he KNEW right from wrong. Period.

    Hopefully the civil lawsuits will be enough to break the parents bank, and they won't be able to afford to keep him in "rehab" and he will fail the conditions of his probation. THAT I would like to see. I do have a concern though. Is he an only child? I would hate for a brother or sister to see something like this and think that THEY can do whatever they want and someone else get hurt or killed in the future.

    I understand what it means Bill, it was a quote from the transcripts of the court docs, that sentence was used that way to make a judgement, and yes hopefully a civil trial will hurt their pockets a bit.

    I don't think the kids in the truck with the drunken kid should be allowed to sue unless they were forced in the truck. Just like the drunken kid they made a decision to drink they made the decision to get in with him.

    The BEST-CASE scenarios at this point:


    • The DA pushes for the 'Intoxication Assault' charges that are still pending and Ethan get prosecuted for them (maximum of 3 years in Juvie).

    • The civil lawsuits stick, and the family is sued for more than they can pay, and they can no longer afford the $450k/year country-club rehab center, which would violate his sentence/probation and he goes to jail.

    • Street Justice prevails and he learns the hard way that no amount of money can save him from people just as ignorant and reckless as he is.

    Exactly..as a homeowner I have a fence and gate around my pool that exceed my town regs. The inspector in my town, by his own admission, requires more than the state regs and is very strict due to accidents in the past. I agree, and would feel horrible if something happened. I am also very militant about who is invited over, I won't even let my sister (who is responsible and then some) bring her kids over if nobody is home.

    That said, there's also my right to have uninvited guests not on my property as well. If I ever came home and found someone in my pool I would probably beat their ass half to death for being so selfish and ignorant.

    While I agree with your general statement, the famous McDonald's coffee case has a lot more to it.

    The restaurant had been cited numerous times for the coffee being above the temperature it was supposed to be.

    The award, while initially substantial, did get reduced a good amount on appeal.

    The lady had severe burns. Skin grafts I believe and quite a few. Her labia was seriously harmed. How much is it worth to you if you sear your cash and prizes on coffee that the restaurant damn well knew was too hot and continued to not address it?

    Now that that's out, I'll agree that personal responsibility and common sense seem to have gone the way of the dodo bird and I don't like it.
