    To be honest the kid should face some hefty time in jail. He made the decision and got drunk which lead to people dying. So he should be tried as an adult and not be let off easily. I personally think a good old fashioned ass whooping on kids these days would solve a lot of issues.

    Seriously if you feel coffee you know it is hot. But if you put it between your legs and spill it on yourself it is your damn fault. Its time personal responsibility made a comeback.

    Exactly. Here in MA it is possible for a 1st OUI to face jail time of a year, at least back in 2002 it was. I'm sure if anything it's more now since a few years ago saw an increase in OUI penalties in many ways.

    In general the discipline (or lack thereof) is the issue. Doesn't even have to be physical, just some consequence.

    I myself don't drink coffee or any other hot liquid. That said, I'd agree with that were it not for the fact that the restaurant had been cited more than once and told to lower the temperature, which they did not do. Hence there is SOME liability by them. Were the coffee within the range it had been required to be then yes the restaurant is not to blame, put the damn thing in the cupholder or just wait till later.

    As much as this whole story pisses me off, I agree that the only justice will be as stated above. Kinda like the OJ justice all over and eventually he will F-up and end up in the pokie adn his parents will be in the poor house, so he will have to plead the opposite of 'afluenzia' which is like 'broke-ass-enzia', don't quote me on that as I did not wikipedia it.:notsure:

    Since it was a plea deal, the arguments of the case are not entered into case law.
    They may be cited in other cases, but they are not a "gimmie" as they might be if the case went to trial and there was an actual acquittal.

    But if it were a trial, since this is a penalty issue, I'm not sure how the arguments would apply to case law.

    Texas prosecutors are again trying to put a drunk-driving teen behind bars after he received only 10 years probation for a June crash that killed four people and seriously injured two more.

    According to NBC DFW, Ethan Couch, 16, was given 10 years probation and ordered to a ritzy rehabilitation clinic for alcoholism after pleading guilty to four counts of manslaughter. The Tarrant District Attorney had sought the maximum penalty of 20 years in prison.

    There are, however, still two intoxication assault charges pending against Couch. The DA is seeking the maximum sentence in those cases – three years in a juvenile detention facility – from which Couch could not be released before his 19th birthday. The Fort Wayne Star-Telegram reported Judge Jean Boyd, who handed down the original, watered-down punishment, may also give Couch no punishment on these charges. That seems likely, as the judge did not sentence jail time for the more serious charges. Judge Boyd has faced considerable blacklash following the ruling: there is a petition on Change.org for the judge's removal that has garnered more than 15,000 signatures.

    Couch had a blood alcohol content three times the legal limit and had Valium in his bloodstream when he crashed his truck into several people who were helping a stalled car on the side of the road. His defense lawyers argued Couch could not be held responsible for the deaths because he suffered from a disorder where the rich and privileged are unable to comprehend the consequences of their actions, a disorder known as 'Affluenza,' which is not recognized by the American Psychiatric Association as a legitimate disorder.

    The families of those killed and hurt in the crash have filed five civil suits seeking damages against Couch, including the family of one of his passengers, who was paralyzed in the crash.

    ON EDIT: And it looks like the truck the little POS was driving was/is company owned.

    Right. 10 to 20m on Manta some other sites estimating 5 to 10m of gross revenue.

    that's the same with smoking,,how in the heck can people get awarded huge sums of cash because the willingly picked up a *** and smoked it. Maybe this family can sue the people who made the alcohol.
