    I have found that a non-compete is difficult to enforce and *most companies won't go thru the trouble of enforcement.

    When I worked for Ma Bell I had the same type of clause I had to sign every year. I could not do side jobs. Once I transitioned over to the private sector there were no such agreements in place. At one point in time I had my own company. Made an extra 25 to 45K per year doing side jobs.

    Yea, they told me I would have to sign one when I was hired, but I wasn't going to remind them I hadn't.


    I see no benefits in signing it besides retaining my current employment. Not sure how it could be a good thing except I'm finally important enough to worry about legally.

    Yep, and so does the 500 miles to someone who only ever lived in the same county.

    NJ can fire at anytime.

    Problem is I loose leverage by signing it. If it's good for two years after my dismissal WTF am I supposed to do until then? Should I ask for a 2 years severance package? LMAO

    I have two guys now who own companies and want me to do estimating for them on the side. I could make some serious side cash, but it would be immoral to do so. I'd literally be bidding myself jobs at my day job. I would have to make up a alias and if any of my customers ever found out I would be fired on the spot and blacklisted from my local market. Yea..............NOT worth it.

    I had to sign one where I'm at. I look at it a couple of ways. One, mine is only 50 miles and 1 year, so it isn't that bad. Two, Iowa is a right to work state. They can't take away my right to work, so that is going against them. If I leave the company, i can see them having the right to try to enforce this. If they fire me and I have to go find a job, they can kiss my ass. I'll work where ever I can find a job.

    I know in MT those clauses are only valid if YOU choose to leave your job - if you get laid off or fired they can't enforce them.
