    Thanks everybody for all the help and yes I know that the bullshit Traction Control system is electronic on my truck and does nothing but make the situation worse, which is why I never drive with it on.







    I've been looking up websites to help with warranty laws. Everything is saying that they have to prove that the aftermarket parts caused the damage. And by law they can not void my warranty.

    Most dealer lifted trucks are lifted by another shop. And is "covered" under their own warranty. The dealer I had went to for repairs had even told me they have had problems with a few shops, but those problems are covered under warranty. But he forgot to mention those were lifted parts and not stock drive train lol

    all in all dealer tries to save as much money by not doing any repairs or making excuses not to fix anything under warranty

    Don't they still get paid for warranty work through Toyota?


    I'm going up to the dealership tomorrow and will get the print out of all parts and cost. Then I'll post everything here. Maybe that will settle the LSD dispute..lol And if after that someone thinks it's still wrong, then I'll give you the phone number for the service department..lol.

    I'm riding up there tomorrow to get all the paper work for the repairs. And always keep my cool and show that I was raised with manners..lol I even apologized to the lady, if I had seemed a little aggravated.

    It is time to escalate your claim. There is nothing that the automatic LSD can do to cause the spider gears to break. Spider gears allow the rear and or front wheels to travel at different speeds when going around a corner but still keep both halves of the axle connected to deliver power to both of the wheels most of the time. They are the differential in the rear end which in many applications is called a final drive. The reason spider gears go out is because they were required to transfer the power only to one wheel for an extended period of high load. Example you jacked one wheel off the ground and cause that wheel to spin while the other was stationary and used the spinning wheel to power some device or operated it at a high speed for a long period. Or with one wheel on ice the other on pavement you unmercifully spun the tire on the ice while not moving the vehicle. Or a extreme shock load applied when one spinning wheel suddenly gained traction. A malfunction of the A-LSD could apply the rear brake on one side and give you the symptoms you describe but unless that rear tire was locked up and skidding along the road or you were doing one tire burn outs it would not cause failure of the spider gears.

    Something else was the cause of the differential's failure IMHO. I think the reason they are trying to get you to pay is they don't want the warranty claim going against there dealership warranty claim record. Do a lot of warranty work and who ever is backing the warranty is losing money and going to put some pressure on the service department to refuse claims.
    A positive outcome for the customer does not enter the equation.

    From the Federal Trade Commission's own website:

    "The FTC says the manufacturer or dealer must show that the aftermarket or recycled part caused the need for repairs before denying warranty coverage."

    The act specificall is the Magnuson-Moss Warranty Act, US Code- Title 15, Chapter 50, Sections 2301-2312. The exact wording is:

    " In fulfilling the duties under subsection (a) of this section respecting a written warranty, the warrantor shall not impose any duty other than notification upon any consumer as a condition of securing remedy of any consumer product which malfunctions, is defective, or does not conform to the written warranty, unless the warrantor has demonstrated in a rulemaking proceeding, or can demonstrate in an administrative or judicial enforcement proceeding (including private enforcement), or in an informal dispute settlement proceeding, that such a duty is reasonable."


    The bold section places the burden of proof on Toyota regarding the lift, not you. Good to know for any warranty repair, as they also have to prove that any charge whatsoever against you has to be proved reasonable.

    just spent almost an hour on the phone with Toyota and they are telling the dealership that they can not void my warranty and have to determine that the aftermarket parts are what caused the issue. im sure they will have their master mechanic look at it and come up with some reason for the failure.

    I went over this with a buddy of mine that had just bought a Honda CRZ. He was telling me that he wanted to change the radio and possibly the coilovers but it would void his warranty. so I showed him the laws that had past had how they protect us as consumers.

    So just for an example, I asked the lady at the dealership if I had 1000 miles on my truck and the best warranty available, and I had put the after market lift on my truck then my radio blew out. Would you replace my radio and she said no, because you voided the warranty by altering the suspension.

    No way in hell the tires made the diff burst with 50k miles. You barely went up in size, in fact you might have made it easier on the diff with a narrower tire. I don't see how the lift would have any effect ...
