    I would ask him politely one more time to move his cattle back onto his own property as you wish to use the land that you purchased. When he hem's and haw's, state that you are left no choice but to make it a legal matter and you have retained an attorney to handle the situation. Maybe that will be enough for him to move his beef and end it all - saving you some $ with the attorney.


    If not, there are plenty of good suggestions here for dinner tomorrow night.


    These matters piss me off because at the end of the day, you have to prove that is your land which most of the time requires having a surveyor stake out the property line (which can run anywhere from a few hundred, to a few thousand depending on your parcel). Sometimes the legal threat from an attorney is enough to scare them off, but from the sounds of this guy, he will tell you to go pound sand.


    Time to start throwing wild parties and blasting music!

    Pretty sure he does not have the funds to go to court as he was waiting on a check for a auto accident which totaled his car only 3 weeks ago and could not afford to get another car until the check came, the check was for 3K

    Which reminds me... F'in asshat shuttled him around for a week helping him look for a car, and i fed the dang cows and his chickin's for a week since he was to hurt to move for a while wait till he needs help next time.

    For everybody who can't understand why the OP doesn't just "kick him off", take the cows, or who think trespassing is a simple issue, it ain't that easy. For most states like has been said the cops don't involve themselves with property issues, and also most states need to prove tresspassing somehow.

    I just went through a similar issue with my neighbor, ended up costing me nearly $1200 for a licensed surveyor, fence materials, and 5 days of my time and labor to put a fence up. After all that I was still having issues with this guy, he basically claimed a full acre of land that isn't his and is dumping yard clippings, branches, leaves, etc and also cutting trees down for firewood. I've called the cops but they can't do anything unless I can PROVE the guy was trespassing so I've finally setup a trail cam along my property line to try to catch him.

    Also, for my state even that isn't enough, I had to send him a 'letter of trespass' and post no trespass signs before the cops would even listen to my complaint. So if any of you ever have a property dispute, save up the cash because you'll need it, seems like its a pretty complicated issue no matter where you live.

    Hopefully things work out for you OP.

    Oh yeah, if anybody is wondering why the OP even cares, it's his god damn property. He owns it, he pays taxes on it, it's his!

    A search of Florida livestock and grazing law will show case studies where the FL Supreme Court upheld the rights of property owners to keep livestock off their property with the burden (fencing) upon the livestock owner. This includes public & private roadways in addition to public and private lands.

    Now...proving your case could become expensive. And collecting on a judgement to recoup those expenses could prove difficult. Especially if you are dealing with a cantankerous neighbor who you took to court.

    A handshake agreement to undo a handshake contract would be the best resolve.

    The lease is a pretty good idea IMO

    But, if the guy was reasonable, he would have moved the cows when asked since he knows that the property doesn't belong to him

    When you can't use your own property because a neighbor is using it, the situation isn't going to end well

    If you don't stand up for yourself ... who will ?

    You could tell him you are taking your fence down to replace it. If he doesn't move his cows to his own containment, they will soon be free range cows.

    I have a vacant lot in SW FL, and I have to get the grass cut 8 times a year to comply with the associoation, before I cleared it it was ok to have brush and trees on there, now that it only has one tree left I have to mow it...

    I think FL is the worst state for that, my family has more land and it's always a struggle, hell you can't even take down a palm tree without getting in trouble so I think moving a cow will be fun

    I also own a vacant residential lot in SW FL and the city will fine me if I don't keep it mowed. Costs me a couple hundred a year. Not a biggie.

    Exactly. I run all that kind of crap through a title company. That way they cover it if they make the mistake.
