    OP just tell the guy to get the hell off your property your agreement was word of mouth only so technically it is not legally binding. If I were you I would be getting eviction things going. Just tell the guy its time to leave ok my dad is gone and the agreement we had is over. I feel there is some missing information to the story but whatever just get real and kick him off.

    The title work found the issue. The attorney cleared it up.

    Same here I found a guy that does it for $110 a year, I can give you his contact if it's Charlotte County...

    anyway...sometimes common sense is not so common anymore, there should be no problem you would think getting those cows off the property but then again it gets complicated

    Our neighbors cows kept getting out destroying our property and what we did is call the animal control. They came out and picked them up. I think they had to pay to get them back. We warned them enough. Scared them off of our property plenty of times. It only took one call and we never had a problem again.

    Even if the cows stay, I'd start making it my responsibility to maintaining the property immediately to remove any doubt of ownership.

    Since it's your property you can shoot on it, right? So if you decide that you want to fire off a couple thousand rounds to sight in an AR, on your property, you think that those cows will still want to hang around? The sheriff can't stop you from shooting on your property, so long as it is otherwise legal for you to do so (i.e., I assume this is rural land). If that lawful activity adversely effects some trespassing cattle, that's not your problem...

    Before you guys start "FLAMING" the Sheriff's Department, they're correct when they say its a Civil matter. Due to the fact that there was a prior agreement. Whether that agreement was verbal, written or agreed upon by a handshake, it will more than likely be recognized by the courts. Doesn't make it right, but that's the way it is.

    I'd contact an attorney and have him write a letter of "Stop and Desist" to the guy and include that he has so many days to remove the cows from your property otherwise they either become your property or that you'll have them removed at his expense. At least that way you have something to hold up to the Sheriff's Department when it gets ugly.

    I think that the Sheriff could've handled it differently knowing that there has been a change of property ownership and asked the guy to remove the cows. It does look as though they were kissing it off. But they were correct to say that it is a civil matter.

    Good luck, let us know how it turns out. And if you do inherit the cows, I like my steak medium.

    Sounds like a fairly simple solution:

    1) Herd his cows back on his property.
    2) Get your land surveyed, then
    3) Build new, strong fence, then
    4) Put no tresspassing signs up and down the property line.

    Or.. what if he threatened you which he kind of did. Request a restraining order that you are in fear of your life. Now he will not be allowed to come on to your property he would be forced to move his cows.
