This very much reminds me of the stupid rules for using dogs for deer hunting in VA. Dogs can enter your property at any time and sweep the deer out, and hunters are allowed to trespass to retrieve them as long as theyre not armed. Therefore, 'hunting' here consists of roads being clogged with hunters in pickup trucks either idling on the side of the road waiting for their dogs to flush deer off of your property, or endlessly driving up and down trying to find them with their radio receiver. Id rather have a squatter with cows on my land . . .

just to try and make sure you all understand this...

The Sheriffs dept can arrest me if I go on to that section of my property and he calls them all he has to say is I am harassing his cattle.

I can do nothing to the fence line as I could be arrested for endangering Ass-Hat's Property (the cattle).

I have clear title to my property, have title insurance and all that.

This Ass Hat has a one half acre plot next to me and does not have the room for the Cattle, and cannot place them on his land legally due to code restrictions.

Just a bunch of old crap
Unfortunately it's probably going to take one attorney consultation and potentially retaining an attorney so you can do this the long but legal way. You'll end up with a bad neighbor and have nothing but problems.

Early in this thread, there was a post about being diplomatic and taking over some beers and talking it out. Let this guy know that you have plans for the property in the near/distant future and be realistic about it. Say you want to work something out, and give everyone reasonable time to do so. Maybe you lease the land to him for a cheap cost, or make the cow pen smaller than it is now, but reasonable. If he's still a dick, throw the lawyer at him and when you win, make him pay unreasonable attorney fees and just ignore the guy. If he's a problem, you keep calling the police until he finally bugs off.

Or burn his fucking house down and beat him at the asshole neighbor game. I give people one good chance to admit they're wrong, then I throw haymakers instead of jabs. He's playing tough, but he knows he's wrong. Something has to give... why should it be you?

The OP may, and most likely would win a judgement removing the livestock from his property.
Collecting expenses from the neighbor as part of that judgement is another story.
Burning down the neighbors home...hurting his cattle...or any other unlawful act would be a foolish thing to do.

My only question is why the hell don't you charge him rent? It makes no sense that you can't kick him off your land!

I just read the OPs statement where he said his neighbor is a 'long time family friend' ... He's been watering and feeding his cows for free for years

No wonder he doesn't want to give up his ability to use your land - who doesn't like free subsidies with no responsibility

Plus with a name like Ass Hat - he's probably getting tired of being called that
