Thanks a lot! Here in AZ we have Monsoon season which is about 4 months of big lightning and dust storms. Its my favorite time of year and a great opportunity for some awesome lightning pics.

Just reading the title looks shitty.

 

I'm not sure what to think. The whole thing is clouded by the employment deal and whatever usage CR was entitled to by any agreement it had with Silverback.

Let's say the photo in question was taken before that. I would say there is a written contract to use the photo for CR's Facebook page. But no other usage was requested or granted. If that is the only picture the photographer sought compensation for, I think Color Run was sorely mistaken for taking the action it has.

The note said the demands appeared in a legal document. So if he's blowing smoke, it certainly wouldn't help his suit.

If I had to guess, I think ole Max got pissed off when he walked into the Sportmart. As he should have. So he probably sent a angry-gram (never a good idea) with his 'demands'.

Meanwhile, the CR people went defensive and sued him for the other BS. They're probably legally not the same (copyright vs whatever you want to call the demands) but they will use one to mitigate the other.

I don't think this is good for either party to be honest.

this was bad on both ends, but to sue the kid when they never paid for the image and used it for commercial ad use just perpetuates this clusterfk...

the kid got greedy trying to charge so much for an image that was happenstance...

in that initial email, color run only mentioned social network usage online, not in print and not for retail advertisement, so i can see where he got miffed...

personally, he should have let it go and used it as part of his tearsheet portfolio to move onto bigger and better things...

 

The way I read it, CR wasn't disputing/referring to his original image but to other work he did while working for Silverback. Recall, he wanted to sell that-that is what he was asking a metric shit ton of money for.

 

i am thinking maybe color run is launching the lawsuit to pressure this kid to back down...

 

That was what I was thinking when I suggested they'd use their suit to mitigate his claims.

 

My dumbass bought a 50 mm 1.8 on ebay last week. Get it and come to find out I actually bought a FD lens. Great.... live and learn I guess.
