    What if the aftermarket suspension is what is on the truck and they decide to fix it? Say one control arm is bad, they can't mix match and have different components on one side.

    If they happen to total it, then i can understand that

    Most likely because they were cheaper than stock parts. Stock leaf springs are like $700 each.

    As far as mismatching goes, if your aftermarket control arms are more expensive than factory ones, I think you're gonna have to pay the difference.

    I don't work for the insurance companies, but I do know some friends that do, so I can definitely ask them. All this information is gathered in a social situation where we talk about work. I am no expert, so please take this all with a grain of salt!

    Glad you ok man, that dont look good. i got rear end on a accident 2 months ago my cost was over 10K, the whole bed was replace and part of the frame where the bumper connects was replace.

    The body shop just started taking it apart on Friday. They did say it had some frame damage but it didn't look too bad. They won't know until they take it all apart.

    Does anyone know if i have any say in what they do as far as the frame? I get the feeling the insurance company might just try to fix it or replace the frame. I am hoping for a total loss and keeping my fingers crossed.

    The adjuster also said that they don't have to use OEM parts as per my policy. The other persons insurance has not accepted liability yet, so as of now it's going through my insurance.

    Since the other insurance hasn't accepted liability yet, i haven't got a rental car from them either. As of now i am paying for rentals, and hope i can get reimbursed.

    Any tips or help you guys can offer, is always appreciated.

    Step tubes,Window tint, HomelinK rear view mirror, changed the entune image screen Rear Differential Breather Relocation Extended AC condensate hose KB Voodoo tailgate cap Redline Tuning QuickLIFT ELITE hood lift system.
    You would be surprised what they will repair .
    I just went thru this with an 2011 Nissan Altima, almost $14,000 in damage.
    The entire front end was replaced, engine and trans. were okay.
    I was not a happy camper to have this car repaired.

    The one thing you can count on, that truck will never be the same.
    This is my wife's car, a girl turned in front of her, she was excluded from Daddy's insurance.

    You need to go ahead and file on your insurance, that's what we had to do.
    This got us in a rental fast.

    Did you mention this to your adjuster or did you have to escalate? If so who did you have to speak to that had the final say?

    I would demand that they show me in writing where the policy said that they do not have to use OEM Parts. It may say that, but make them show it to you.

    Why would the at fault parties insurance company have to accept responsibility. She was ticketed I presume for what ever. It was her fault and they should provide you with a rental car. If your insurance is having issues with hers then they should provide you with a rental and then pursue her insurance for reimbursement.

    I think you need a better insurance company. The one you have sucks.

    How this works:
    If you put the claim through the other persons insurance, they will look at the facts and determine if they think their party is 100% at fault. If so they should provide you a rental and get the estimate for your repairs. If they believe you are at partial fault ( 80% to 20% ) then things get complicated. pros of going through their ins is they pay for rental and you dont have to pay for your deductable.

    If you go through your insurance, you company will pay for what your policy has. for example rental, if you have it they pay for it. If you dont, they wont pay for it. Downside is you have to pay your deductable. Upside is you dont have to deal with the other insurance company at all. If determined they are at fault, you should get your deductable back after the claim is settled, but could take some time

    Wrong. The insurance company doesn't get to determine shit about who is or is not at fault. The police determine who is at fault or the court does.

    That is how it works. Unless you fall under the no fault rules, (where your insurance covers you and her insurance covers her). You are doing it wrong. But hey if you want to get bent over feel free to do so.

    She failed to yield the right of way as per the OPs post.

    She was 100% at fault as per the law.

    Did she get a ticket? We can yes assume from the OP's post.

    Did he get a ticket? We don't know, but as per the OP, No.

    What did the police accident report say about fault? We don't know that either.

    Wrong, we determine if a traffic violation occurred...we don't have a thing to do with who writes the check. Based on statements of drivers etc the insurance co may decide both drivers were at fault.

    Ex. your traveling 40 in a 25, a car turns in front of you. They have failed to yield to you, however had you been going 25 in a 25 the accident may have been prevented. I cannot cite you for speeding however your speed played a part in the accident. The driver that turned in front of you's insurance will most likely not pay 100%.

    Just because we write a citation does not mean they are convicted or guilty.

    How do you have any idea how fast anyone was going? You weren't there. Unless the dummy admitted speeding, then they deserve whatever happens to them.

    A ticket or citation doesn't mean you are guilty or convicted. The police may not Directly Determine guilt, BUT if one driver is ticketed for failure to yield and the other is not ticketed, what do you think the court will say about who is to blame? If the driver doesn't do something stupid and admit that they were speeding? That is why I included the court in my post above.

    In my experience similar to the OP. The accident report was written by the state police, the other driver was ticketed for failure to yield the right of way. There was no wiggle room, what do you think the court is going to back. The police.
