    Setting up a NFA trust, we're gonna have all the paperwork done the day before my birthday and on my birthday we're gonna botarize it and all so it's legal, then I can send off for a tax stamp for a SBR.

    Close, National Firearms Act, basically says barrels have to be a certain length or else you have to apply for a SBR or SBS tax stamp.
    And you have to get a tax stamp for suppressors.

    I don't have to, but it makes it a lot easier.


    The NFA states that you have to have a $200 tax stamp and a background check/approval to buy anything that is covered under NFA regulations (Short barreled rifle, short barreled shotgun, fully automatic weapons, AOW's, and suppressors).

    If a person applies for the tax stamp as a person and not as a trust they have to get local law enforcement approval, fingerprints submitted, picture submitted, and the rest of the form.

    If a trust applies for the tax stamp they only have to fill out the form (standard background check). Another + for the trust method is anyone listed on the trust is a owner, meaning they can use,transport, and possess the NFA item.
    If a person loans out a NFA item they have to stay with it at all times otherwise it's a felony if they get caught.

    Rumor has it that some trust applications get processed faster than individual applications.

    I have no idea, I do know it's called a revocable living trust.

    ok so it is the same. the trust owns the gun and as a person with legal interest in the trust you have rights to it.

    I did not know you could do that, but it makes sense seeing how the trust is a legal entity. Really though isnt it easier to just apply for it on a personal level then go through the process of establishing a trust?

    Yeah, for most folks they'd rather just not bother with a trust.
    The trust is also kind of a will for me, if I die and I don't have a trust all my NFA items get confiscated, if I'm in a trust the trust keeps ownership of the NFA items and my trustee (?) gets the items.

    It depends on what you want, I personally wanted the ability for someone else to be able to transport my weapons if there was a hurricane or if we were out shooting and I wasn't able to go directly home.

    It does add to the cost, if I sent my form 1 in as personal application I'd only have to pay the $200 tax stamp fee, to create a trust is $250, and I still have to pay the $200 for each tax stamp.
