    Why do I care whether his insurance company is happy with me or not?? They shouldn't be happy with my neighbor if anyone!! So what they KBB the value before the accident and after. How do they determine what its worth after the accident? Thanks for the info :)

    The other guys insurance company's claims adjusters are most likely going to be the ones trying to say wht your truck was worth vs wht its worth now, but you do have a right to do your own homework lol My advice to you is to do one of 2 things..1) hire a company to do it for you, which you can find in the links or 2) this is what I would do, write down wht truck you have and all the options + any mods you have done and take it to 1-2 appraisers, get the official apraisals for before and after the damage and then take them to the other guys insurance company..you can also do this yourself by looking at similar tacomas in your area, but you'll have to see wht yours will sell for with damage..Sorry I'm starting to ramble lol last thing and I believe someone may have already said this, but you can always go to your insurance company with questions about this, they shld be more than willing to help you since they're not paying lol but good luck!

    I just did a KBB analysis with my truck being in excellent condition 33,522 very good 32,706 and good 31,783. I think those are very reasonable with the differences being: $816 or $1,739. I really don't wanna have to pay for an official appraisal.

    Call your insurance company and see if they have anyone willing to help you out with DV. I know that If one of my clients called in I would be helping them out. Might be a route to at least try

    I don't think his car insurance has anything to do with it. His car was not involved in the accident.

    You are correct it will be his homeowners insurance. Also, just went by the paint and body shop and they said the entire vehicle will have to be painted. The trampoline springs after a good wash yesterday touched or scratched every part of the truck. Hmmm maybe if the cost of the paint for the bumpers/labor is the same or more than some Bruteforce bumpers I will have them not paint them and order some armor from Billy :)

    So now my neighbor is trying to get my Liability homeowners insurance to cover everything!!! F that as it was his damn fault/negligence for not staking down the trampoline. Also, he is trying to say I want have a carfax!! Bullshit the insurance companies file it!!

    Exactly what I said. My insurance company has already come out and inspected everything. His will be out this afternoon for a statement and to look at everything. I also have two neighbors who saw the trampoline lift off the ground and fly across the street. I am almost 100% it will be on my carfax!! I am going to jump his shit if he try's one more time to put this on my insurance period!! Fucking nerve of some people!!:mad::mad:

    Exactly!! He didn't have the damn thing staked down he is lying and telling everyone he did, but I just read that someones withheld winds in excess of 50-60mph with theirs staked down and we have super hard clay in Florida. Hence why he didn't wanna retie them down when he moved it.

    So here's what you need to do now. You need to get a copy of the instructions/manual for the trampoline that he has. If you can find that and find somewhere in there that it say to tie it down, then you have proof that he is negligent. I have been talking about this story here in the office and this is wht I have come up with based on what everyone says. If you can't prove that he is negligent, then you most likely won't be able to have his company pay.

    Exactly, If you or your insurance company cannot prove negligence then it will go on Your auto policy. Now I can't say for sure but if it ends up on your auto policy, it might not count against you. Also, once it goes on your auto policy your insurance company has the choice to suborgate your neighbor's insurance co by taking them to court. If they do and win then you'll at least get you deductible back

    If that's your neighbors trampoline suggest they get some anchors to tie it down, when they come pick it up. They make anchors specifically for this purpose, I bought several for my kids trampoline.

    I certainly hope he bed isn't bent from the trampoline, probably just bent the bed-side or shifted it.

    He told me on the phone he didn't tie it down because he just moved it for his kids bday party, then when he gets there tells everyone he had it staked down. I am going to the empty lot next to him today and taking pictures of his yard where it should have been tied down for proof along with pictures I already have that shows nothing tied down or attached anywhere on his trampoline. No he is committing fraud lying to his and my insurance company. Plus we only had gusts up to 30mph that should have never picked up a trampoline that was staked to the ground.

    Staked down or not, isn't he responsible? Seems to me that if my property damages someone else's I'd be responsible for that. I'm a pretty ethical person, I'd have a hard time sleeping if I didn't make it right.

    No, it falls under the same thing as if your tree falls on your neighbors car, your neighbor would have to use his auto policy to cover the damage, not you. NOW this being said, if you had been told that the tree was rotting and could fall down, and you do nothing about it, then you would be the one liable if it fell on your neighbors car. SO in this situation, if he can prove that the instructions for the trampoline say to stake it down, then his neighbor would be held liable for the damage

    Yeah his insurance company hasn't let me know yet whether or not they are going to cover it. He basically said he would pay my deductible to get my truck fixed if they want pay for anything. Geico also said if I wanted to recoup the money from his insurance they will proceed with mediation to get it, but takes forever for all of that to get resolved. I also asked them if I did file the claim with them if my insurance would go up and they said it wound not.
