    This is what my HO insurance said as well unfortunately. I still think being my other neighbors saw the incident and witnessed it just up and flying across the road with no resistance of anything staked down that they will fully cover everything. We will see and I can't decide whether or not I want to wait and hear from his insurance or go ahead and use mine.

    I would get this ^^^ in writing!!!!
    As far as turning it into your company or not, I would wait as long as you can. I believe I've said it before, but if you turn it in to your company, you lose the right to take the guy to court, unless your company doesn't pursue him. But at the same time, if you DO turn it in, your company can take him and/or his company to court and try to get everything back including your deductible

    Yeah that is a good idea. I should definitely get it in writing and how do I attach a pdf document?

    SPECIAL CONSIDERATIONS

    High Wind

    It is possible for the trampoline and enclosure to be blown about by high winds. If you expect high winds, move the

    trampoline and enclosure to a sheltered location. Disassemble (take down) the enclosure netting. Tie the trampoline

    frame down to the ground using ropes and stakes (not included). At least three ropes and three stakes should be

    used. Make sure to attach the ropes to the top of the trampoline frame: do not simply secure the legs or the bases to the

    ground as they can separate from the frame sockets.The tops of the stakes should be at ground level so that they will not

    create a tripping hazard. In addition, the tops of the stakes should be covered, if necessary, so that users will not be hurt by

    falling onto the stakes.

    I got it :) His manual def says to stake it down and I have tons of pictures shown where there are no tie downs attached at all.

    Just received this from the agent that did the interview for his insurance company:

    My best guess is about thirty (30) days but it could be sooner or even longer. sorry but this is not the kind of claim that is automatically covered. it is based on whether or not the company feels that Mr. C..... was negligent since this type of event is considered an "Act of God" which does not impute or imply negligence on the part of the owner of the trampoline.


    I will advise you when I know the companies' position. The claim is being investigated under a "Reservation of Rights".

    If you haven't do it already, send the manual to your agent ASAP! It prove he is negligent even if its only partially. You shldnt end up paying anything. I would also make sure you get a rental car if its gonna take long.

    Also remember that the advice I give you is how my company would handle it in Ohio. Things might be slightly different for you!

    Thanks for all the advice and I sent it to his insurance agent and told him what page it told him to tie down the trampoline or disassemble it in high winds. I am going to wait to get my truck fixed until his insurance company tells me something. Nothing is in dire need of being fixed although the windshield is cracked pretty good.

    This is my last response I got: Should I just go ahead and file with Geico?

    We are awaiting a decision from the company but do not expect it will come in the next few days. Geico can & will replace your windshield under your comprehensive coverage with no deductible as mandated by state law.
    You need only to take your car and your policy to a local glass shop and the shop will handle the replacement and bill GEICO directly. I will advise you immediately when i receive instructions from the company but as I have advised previously, it will be much quicker and easier for you to have GEICO handle the repairs and "Subrogate" against Mr. Chicco and Federated National.

    Should I just ask him to pay the $500 deductible and let Geico pursue this claim. They said my insurance wont go up.

    I am sick of looking at a busted windshield and dent in my cab.

    If he is willing to pay the deductible, and your ins doesn't increase ( it shouldn't ). That is what I would do. Then it is Geico's issue to deal with and no more worries. I am sure GEICO will go after them with their own well paid lawyers etc...

    If you can get him to pay your deductible I say do that. But you have to tell your insurance company that he is. When your company goes to suborgation, they will try to get back everything they spent including your deductible. And just an FYI, The process of suborgation can take a long time unless the other guys company willingly participates.

    Well he decided he didn't want to just pay the deductible and wanted to get his attorney involved. F him now I will just let Geico do all the work and get all the money back and I hope he has to eat all costs with his attorney lol. I am taking my truck in at 11:30 for Geico to look at and should get a check cut today then I will probably have them start working on it after the weekend.

    Yes scratches all over the body, hood, roof, panels, etc. They aren't bad enough where I can't deal with it. I bet some of the trail trucks on here are way worse than mine. The only way you notice them is if I were to point them out to you. The worst one is on my rear bumper which I might be using the insurance monies to buy a Bruteforce high clearance so I am not worried about that one. Also, fiberglass in the future too :)

    Yeah I am pretty laid back, but this does piss me off!! He is an ass and like he said above. He can waste all his money and time with an attorney while Geico drags this out and gets recouped. He has shitty cheap homeowners insurance anyways. Ill let Geico take all their money and his :) Big v Small

    So I am back from the estimate and what of course they wanna try and buff out my entire truck before repainting the whole thing and didn't even cut me a check for it. I guess Ill head to the next body shop with a different rep. This shit pisses me off!!
