    It just means don't do it right now cause it's fresh and in the future we will consider penalties on a case by case basis, which is fine for me, this is more of an awareness/education thing, should be common sense not to walk across the track while cars are running.

    There are so many sanctioning bodies that assume that the operators will have common sense...but the fact is alot of them don't. I myself....in a race situation...wouldn't even think of getting out of the car and just crossing the track like that. If it was on fire...sure..get out..and move away ( down the track away from the car staying tight to the wall in front of the car ) .

    I look at this and I can see even more reason that Stewart never saw him...

    That's on a bright sunny day..and the view is quite terrible.Now imagine that...in the dark..rounding a turn where the car slides around....and seeing someone in a black suit and helmet on a dark brown track is damn near impossible.....

    In my opinion, it all comes back to changing driver behavior. Fines mean little to most race car drivers big or small, especially when emotions are high during a race. But, if they know they will have to sit out for a few races, that takes away the one thing they desire most. I would hope most will remember that when climbing into the car each time.

    I hope I'm not the only one that sees the irony in the people that, on one hand say "don't be so quick to convict Tony", then on the other hand are quick to defend their hero as if he's somehow absolved of all wrongdoing. Whether intentional or not (of which I'm through debating publicly), the fact that will not change is that Tony Stewart has killed another person.

    Arguably, Ward killed himself. Just happened to be at Stewart's tire and not the guy who swerved first.

    Imagine if that car had ended Ward's life, then we would have no conspiracy theories. Wait.. Unless Stewart paid him to do it! OMFGWTF

    Now add a fogged helmet, sweat dipping off your brow, some mud and enough vibration to detach your corneas. Sorta like a helicopter crash but louder.

    Stewart may have seen him at the last second, but that's very doubtful. More likely, he heard the thump.

    naw, more like he felt the thump. with all that noise…and knowing those cars have very stiff suspension(hah..more like not much).
