    I didn't read all the way down lol but I would ask your agent if it applies. If it does, threaten legal action/go to the insurance department/attorney general. If it doesn't, ask your agent wht the exact law is. The is a law, just gotta find the right one lol

    Got an email saying they are sending a denial letter, but I still am not convinced until I actually see it. The actual adjuster that is handling this hasn't responded to anything I have sent and she is supposedly the one sending the letter. I requested a pdf of that letter and sent all pics showing he lied to them about the trampoline being staked down.

    This is the response:

    Justin: The claim # is listed above (sent prematurely). The adjuster handling your claim is Linda Coto. The phone number for Federated National is 1-800-293-2532. Ms Coto has advised me that the claim is being denied as an "act of Nature" and that an official denial letter is being prepared and will go out shortly.


    Also, I have spoken with three members of the "claims team" at GEICO" and have made GEICO aware of the potential denial pending and have given GEICO the claim number and address for Federated National.


    This is an unfortunate situation but is fairly common considering our weather conditions here in the south.

    Most lawyers will give you a free "consultation" (i.e. 15 min for both you and he to feel out the situation and decide if it warrants follow through.) I think the nit picking issue here is whether he was negligent or not (did you say you warned him to tie it down?). See if you can get a free chat with a lawyer and he should tell you if his insurance should pay. IMHO

    (so if someone parks on a hill with and leaves it in neutral and forgets to set the brake. Then the wind pushes it and it roll down into a house -it's only an act of Nature??)

    I second getting with a lawyer. They shld be able to tell you if its worth pursing the company yourself. Worse come to worse you will need to file with your company and then they will purse your neighbor's company and you'll get your deductible back. Only other thing I can suggest is to file a complaint with the insurance department and attorney general like we talked about.

    The frame is fine and good call on asking Geico and being a free attorney. At this point its probably best to just pay the damn deductible and let Geico go after both of them as they are the money makers and know what they are doing.

    The best person to talk to is gonna be your claims adjuster. Once you file the claim you will be assaigned an adjuster and they shld kno everything that you wanna kno. The first people you talk to are just claims reps that start the claims process. They don't kno much haha

    My Insurance is through a Big name insurance co but I have a local Insurance Agency. With my local agency, I have a rep that has been with me for many years. If you have the same I'd call that rep and ask questions.
