I like to be optimistic

 

Start gathering records, texts, voicemails, etc.

If she's been arrested try to get the court docs... if she has been in a mental institution same thing... if she has a drug problem, same thing.

As the dad, you have to prove she's unfit if you want a chance at custody.

 

I do but I'm not too sure how that's going to look.

 

Get Snorkie to run a rep report on her.

State. She can't leave the state. In reality she can, the only option you have at that point is to claim an abducted child by one parent. Doesn't help your relationship if you have any hopes of saving it.

Exactly correct. Unless a court puts it on paper you are at her mercy. Either parent can take a kid and deny the other parent access until courts get involved. When you do get to court, it does not reflect well on the parent denying access.
