I bumped a guy in my moms car...

    That's fine - they should deny his claim, based on everything you've said.

    However, they still have a responsibility to you as insured (even though they later cancelled you) to indemnify you against this claim which is for an accident that occurred while they insured the vehicle.

    It sounds like you've had a couple of insurance companies over time.

    Let's make sure you're in contact with the right insurance company.

    The insurance company you need is the one that underwrote the VEHICLE you were driving at the time of the the accident (your mom's car, right) AS OF THE TIME OF THE ACCIDENT.

    Also, I keep forgetting you're in Canada. So it's possible the laws may be different. But if you were here in sunny California, that's how you'd do it.

    Anyhow, you have to give them a copy of the summons, along with the appearance date.

    From what I understand is the guy went to his insurance company and tried to put a claim through, since my old insurance company (which was also my moms at the time) denied the claim. Then some guy showed up at my moms house today with the "SUPREME COURT" paper and gave it to me. He wouldn't give me my moms because, well I'm not her..

    He told me to give it to MY insurance company. To me this doesn't make sense, and clearly to you it doesn't either (you're telling me moms insurance at the time of my accident should take care of it, right?).

    I honestly can't see this anywhere.. But the fact that I was given a paper with "SUPREME COURT OF NOVA SCOTIA" on it today has me a little freaked out. This ain't no Judge Judy shit by the sounds of it.

    The last court of appeals is always a "Supreme" court. It means all the lower courts have denied his appeals and he is out of time. Basically, this is it for him. Keep calm, and try to recall as much info from the accident. Try to remember if he looked injured or asked for medical attention. If he sprang out of the car and walked around like normal, make sure you mention that in court. They won't ask you for a medical opinion, but you can tell them if he appeared or acted injured or if the impact was enough to inure you. If he made any statements like "I'm OK" or "glad no one was injured" makes sure you mention that.

    He doesn't get to pick who you choose to represent you.

    The process server doesn't understand the distinction about what insurance companies are involved. When he says "give it to your insurance company" he's just trying to give you somewhat helpful boilerplate advice.

    The fact that your mom's insurance company has already denied the claim is somewhat irrelevant at this point. You don't need them to pay the claim. What you need them to do is indemnify you (that is - defend you in court) which is part of their responsibility when they issue a liability insurance policy.

    And that is why you need to present the summons to them.

    Honestly, I feel a little like someone diagnosing a guy with a 102 degree fever via internet here. The correct advice then is "get the heck off the internet and just call your doctor."

    The correct advice here for you is: "get the heck off the internet and just call the insurance company that covered the car as of the time of the claim occurred." :mad:
