No. Its not illegal to give the truck back to you. Such a law would be completely unconstitutional. Their policy is to convince you to leave it with them until its repaired but they have no laws behind them.

you may want to push them on that issue. I had no problems getting my truck back. A friend of mine had his truck fail inspection and they made him sign a waiver to leave with his truck. I suppose it depends on the severity of the rust issue.

Hence the "" around the "illegal". If its only going to be another week or 2 I am not going to push the issue, if it was goign to be 10-12 more I would.

Im sure its dealership policy and how much liability they want to take. Im sure it varies from dealer to dealer.

It looks like the service campaign is now active in all of the states (CT DE IL IN KY MA MD ME MI MN NH NJ NY OH PA RI VA VT WI WV, & D.C.). At least that is what is listed for my vehicle on the toyota owners website.

Mine is scheduled for inspection on Monday and will definitely need a new frame. The dealer already failed the state inspection because of frame rust.

The service adviser told me each frame is made specifically for each VIN. It takes 10-12 weeks to order a new frame. They also told me I would have to sign a work order which would release them from any liability if I continue to drive the car.

I have a question guys. Say I take my truck in and it doesn't get approved for a frame replacement, even though it's rusting bad. Can I get it back without getting the crc applied and take it back to the dealer at a later date to see if I'll get a new frame?

I just had my truck inspected this morning, mine popped up on the Toyota Owners site as being part of the LSC. Interesting thing, I don't live in any of the listed states but my truck spent the first 98k+ in VA, I am only at about 101k now. When I called my dealer about it they were more than happy to look at it. There is some light surface rust here and there but my frame is solid, they let me look for myself. It's a good thing really since my dealer said they couldn't even order the CRC when he looked in the computer and making a phone call confirmed it would be difficult to get.

Toyota changed their frame supplier for 2009 and newer trucks. These newer frames are made of better quality material.
I have an appointment for January/2015 to have my '05 frame inspected. I was told if there are perforations or significantly weakened areas in the frame it will be replaced. Otherwise they will clean the frame and apply a rust inhibitor. This is a two day job and they are supplying me with a rental vehicle.
    A new frame would be a 6 - 8 week wait and a multi-day job.
Apparently not all dealers are equipped properly to apply the rust inhibitor so I am not having this work done at my usual dealership.
I was also told by the local dealer that they have replaced one frame already due to rust.
    Hope this info helps.

Got the call a few days ago and getting my pictures taken as we speak. I had already taken it to the dealer a few months ago when I saw the LSC going on in other states. I have quite a few holes. Let's see how long they tell me it will take...

I just recently got the notice in the mail. Had no knowledge of this prior, so I started looking here to find answers. I've read a lot of info here, but it's too much to read all the way through.
Not sure if this has been mentioned, but I just have a thought about the cutoff date. Shouldn't the cutoff date be the same amount of time for each year? March 2016 gives 2005's 11 years, but only 8 years for 2008's (which I have).

I think i will be waiting until the beginning of 2016 to have mine checked. I agree with others here that the coating is just going to hide the rust. I'd rather be able to check it out myself right up to the cutoff & then have it coated as a last resort.

My friend who has a 2006 Tacoma & is scheduled for a frame replacement at a NY state dealer, recently received 2 small checks from Toyota? & is afraid to cash them, as he fears they might be from a class action lawsuit, & if he cashes them, Toyota might say he has settled, & then will not replace his frame. He is not sure if they are from Toyota or someone else. I saw a brief mention of a check in an earlier post, but no explanation. Does anyone know what they might be for, as he said they didn't come with much of an explanation.

Has anyone in central NY had any luck actually getting an appointment for the CRC? I called Burdick Toyota (part of Driver's Village in Cicero) and they said they wouldn't even take my name until January; they are currently booked until March. I'm willing to go elsewhere in Syracuse, Rochester, Ithaca, etc if anyone has any leads on dealerships in the area who can apply the CRC.

I was in Dorschel Toyota in Rochester last week and they would have done the inspection, but I am waiting until the spring. I also heard good things(they like to do frame swaps) about LeBrun Toyota in Canandaigua NY but I have not dealt with them myself.
