UCMJ only applies to you once you are in. If he never was in the military he is except I believe.

 

It is, but I think the Stolen Valor Act of 2013 is what makes it a federal crime for civilians. I'll have to check though, not positive.

So, after a quick check according to Chapter 45 of the USC, Sections 771 and 772 no one outside of the military is allowed to wear the uniform unless in a theatrical performance like movies and what not but the uniform cannot discredit that service. Under the Stolen Valor Act makes it a federal crime for anyone outside of the military to use the uniform or any type of medals for any benefits or entitlements

 

You are thinking of Article 134 of the UCMJ. When I was in Korea a new guy showed up with E-6 rank on. All his paperwork said he was an E-5, and apparently he decided to give himself a promotion on the way to his new duty station. He was charged under article 134 and mowed grass till midnight during monsoon season for 45 days, and busted down to E-4.

In certain circumstances, the UCMJ can apply to civilians. A contractor overseas is subject to the UCMJ for some things, generally things that would be felonies stateside.

The only way to handle it is a good old fashioned ass whoopin'.
