    having recently gone through this, I can add some insight.... hopefully the person that hit you had good coverage if they are 100% at fault....

    IF the state minimum for property damage is low say $25k and that is what they have, it is likely the payout from their insurance will not cover the value of your truck.... any difference in value(likely minus your deductible) will have to come from your insurance carrier. IF you don't have the additional options/accessories coverage you won't get paid for the accessories even if you have receipts.

    Removal of parts - anything you remove will need replaced w/ something equivalent. Yes the insurance company starts w/ the equivalent market value of your truck, but ANYTHING that is missing will be used to downgrade the value of your vehicle. The center drink holder was missing from my truck and they marked down the value by $100 b/c i could not find it in the truck after the accident. All parts removal will have to be done at the towing yard as they will not tow the vehicle anywhere or release the vehicle until the tow bill from the accident scene is settled. Once an adjuster looks at the vehicle, any opportunity to swap parts will be gone.

    I wouldn't hold your breath on that. If he turned left in front of someone else he likely will be at fault regardless of if the other person was speeding or not. It varies by state but most will see the person failing to yield the right-of-way as at fault regardless of what the other driver was doing or not doing. It's your responsibility to make sure it's safe before proceeding across the flow of traffic. I've had a few first hand experiences with this (never the driver) in several states to know that's how most states get down.

    Lex, I am glad to hear you are safe. If it hasn't been proven or admitted the other person is at fault I would hold off on posting to TW. Personal experience from a few years ago on a different forum.

    Ps.
    Oz is not a dick, my gf is from where he lives and he more likely is a lumber jack in the day time and misunderstood Vancouver Island Hippie on weekends/evenings.
