Still against NCAA rules to take stuff for free. And it looks like he did it multiple times. And the employee could get fired for it. So yes, it's still a crime.

The penalty for accepting a benefit such as this is paying for it and a suspension. Both happened plus he paid restitution and did community service.

Also that's the employees responsibility if he wants to give away free food to his friends...

So when a bartender wants to give you a beer on the house, I'm sure you say no because it would be stealing right?

It is stealing. Yes. Is it the bartenders drink to be giving away? I know this, I have watched friends get fired and end up in jail for doing it.

No, the employee, who does not own the food, gives it to someone. That is a crime. That is theft. People have been put in jail for less than that.

You wouldn't know whether the bartender had permission to give the drink away…

I do think Winston should have been smarter about the situation and known with his status as an NCAA athlete that he can't accept benefits like free food but it sounds like you are trying to blame Winston for a decision the employee made.

I'm blaming them both for their lack of maturity and integrity. If the BARTENDER was giving away a free shot to someone, he was doing it. Typically the owners will not give away a lot of free drinks. That's bad business practice. You do it once, they expect it. You don't do it the next time, they say you are an asshole and quit coming to your bar.

Theft is theft regardless if it is pennies or millions. He may have been "given" the cake and crab legs, but it was still theft. The employee could have done it out the back door and nobody would have ever said anything about it.

Keep riding your high horse. Not getting into a moral argument about what constitutes stealing (especially since you are criticizing him for being "given" them yet suggesting a better way to do it). Was just pointing out that I think it's ridiculous how one can lambaste a 20 yo kid for accepting some free crab legs.

This is what an NFL GM said about the matter:

“Our investigators found several Publix employees who corroborated what Winston said. Winston told this story to our team and I believe others. We were able to determine that he was telling the truth. I won’t get into more detail than that.

Should Winston have taken free food? No, of course not. But college football stars, at every campus in America, get free stuff. They all do. Every single one.

We feel like Winston was wrong but he’s part of an overall college system where this happens daily. My personal opinion is that on this issue, and this issue alone, he was hung out to dry.”

Might be another painful season for my Gamecocks. Lost a lot on the o-line and some WR's. Don't know how the QB position is going to pan out. Defense should be better. Tough schedule conference schedule with UGA, Mizzou, LSU, and aTm. Also, can't sleep on Tennessee.

Saw that the other day. Take some cash from the football revenue and redistribute it. Seems simple enough to me. They make more than enough to pay everyone and give scholarships and have some to spare.

Hopefully they will surprise us. If we had a good QB, I wouldn't be so worried.

The QB situation is what worries me the most.

The revelation that the crab legs were given to him shouldn't be a surprise. Winston made the decision that it was better to look like a retard and say he "forgot to pay" than to admit he was given free food and knowingly violated NCAA rules (which every college athlete does). He was probably right.. NCAA might have come down harder than the team did in that situation.

It doesn't change my opinion of him, but opinions are like assholes, so who cares anyway? I've been wrongly accused of schadenfreude in the past, but this time it applies... I wholeheartedly look forward to watching him crash and burn at the next level.
