Certainly a non-refundable deposit comes with a pre-negotiated OTD price and hopefully an expiration date...at which time the buyer could get the "non-refundable" deposit back.

I sold a Mazdaspeed Miata a few years ago to someone from about 700 miles away. I accepted a contingent offer over email with no deposit. I advised him I would accept his price, see him this weekend, but that the car would remain for sale. I would advise him if the car sold before he got there so he wouldn't waste his time driving down.

I later sold the hardtop for that Miata to someone near him. The guy contacted me asking how much of a deposit I would need to hold the deposit for 10 days. I told him $120 - 1% of the purchase price ($1200) for each day. I also told him if he didn't show up within those 10 days, I got to keep the money, unless he renewed the deposit for additional days, all of which would be credited to the purchase price. If he showed up, inspected the top, and felt that I had not represented it fairly, then I would refund all the money and he could drive home with no top. Hurricane Sandy rolled into NY/NJ and he was delayed. He kept in contact with me. I did not enforce the additional days/additional deposit part of the agreement. I held the top for him another week (maybe it was 2 weeks). The key was that he kept the communication lines open. I had interest from other buyers in the interim, but because I'd accepted the deposit, I turned them down with the promise I would contact them if it didn't work out.

Wow, I am surprised at the backlash... "entitled"??? really?

I was simply posting what I thought to be a pro-consumer message that points out a less-than-fair business practice. My hopes were to let others on here know, and perhaps (call me a dreamer) we can collectively take a stand against this. I was simply trying to side with others on this forum, who I had assumed were also consumers.

Anyways... I'm taking my business else where and continue to encourage others to do the same if asked for a non-refundable deposit. Cheers.

Capitalism sucks It brings out the worst in people. It presents fraud, corruption, and flat out dishonesty

For instance our healthcare system in this country is a joke Yesterday I went to my knee doctor because I beileve I tore my MCL So the doc checks me out and takes xrays They did not find any damage to my
bones so she suggested that I wear a knee brace for 3 three weeks She brought in this knee brace and put it on my knee Then she says that I will need to pay out of pocket for the knee brace 75.00 and we will be sending the cost for todays visit and knee brace to your insurance company WTF.....so let me get this straight
I pay out of pocket for my knee brace today and you will bill my insurance company for a knee brace as well. After I spent 15 minutes going around in circles with them in which their policy still did not make any sense because they said if the insurance company pays for the brace our sub company will reinburse you Yea right more F#### run around Before I left I ask them for a receipt for services rendered they tell me Oh we will need a few days to generate the lab results and then send it to your insurance company Your insurance company will send you an list of rendered services we provided for today's visit Umm I cant wait to see that bill from my insurance company Who the fuck do these people think they are. What kind of business does not provide you a receipt for services rendered I dont know of any other business like that

Moral of the story CAPITALISM SUCKS no matter what aspect of the USA economy you are dealing with It just brings out the worse in people. Sorry for venting so long

I was asked for a $1000 deposit and agreed, gave my credit card number, and then checked my credit card statement online a few days later. I found that the charge never went through. I called the dealer, and they said they never put deposit charges through. I couldn't figure that out then and I can't now. I never got a good explanation of why they would require a deposit, then never actually take it. It actually makes me uneasy, because without proof that they took a deposit, what compels them to sell the Tacoma I ordered to me when it comes in? If they find another buyer willing to pay more, they could say they never took a deposit from me, so therefore they had no obligation to me.

Dealers are slimey crooks. I had a deal for a tacoma and when we went to sign and finalize the deal they added over 1000 dollars for "documentation fees" . 1000 dollars to sign paperwork? Told him to stick it up his ass and went elsewhere. Buyer beware

What's fair? To start a business with your own money and run it the way you want to?

You aren't required to buy any tacoma, much less a 2016 from this dealer. If you don't like his terms, go somewhere else. It's as simple as that. If enough people don't like his terms, he will either change or go out of business. Either way, it's a choice and not a requirement. Lot's of things to be pissed about these days, but can't see this as one of them.

Go to the dealership and ask them. A too calling. You don't know who you are talking to when calling. If they don't want to charge you, it's because they are going to charge you to deposit when you decide not to purchase a truck. Go there and take your credit card number from them and threaten legal issue if you are ever charged a deposit.
