I actually think it is covered in most cases. Another member rolled his jeep on a trail and they covered him. I also just recalled a time when a friend of mine sunk his truck in a huge "mud" hole (more like a small lake). It was totaled and insurance covered everything.

I'm interested to hear what the adjuster has to say though.

If you knew this driver was snapchatting while driving would that affect them getting anything?

I can only tell you what the TX policy says, but most states are going to be pretty similar.
-Organized racing is excluded from coverage
    -misuse and abuse is excluded
    -intentional acts are excluded

You might be able to argue that off-road use is misuse and abuse, but in TX we don't interpret the policy that way.
My example is on my own vehicle, I was at an offroad park on a difficult trail and caused damage (mostly due to not having rock sliders). It was a covered loss, but it goes under collision coverage as an at fault loss.

I had a recent claim on a jeep that was sunk in a a river, covered everything on that one.

We cover trail damage all the time.

In training we reviewed how other states cover this stuff, but that was nearly 8 years ago so I don't really remember.

Look up your policy and look under damage to vehicle exclusions, should be able to see if it is cover or not. Any ambiguous language will favor the insured not the company. FYI.

4x4s are in a higher risk insurance group than 4x2s. I assume that is because it is more likely to have an off-road accident that must be covered?

I'm not an underwriter, so I don't know for sure. I don't think that is the case though. I believe they are more likely to have a higher premium for 4x4 versus 2wd due to the fact that a 4x4 is a more expensive vehicle and therefore is going to cost the insurance company more if it gets totalled.

I thought the cost of the vehicle was a different part of the equation?

No. Driver is already 100% at fault in this case regardless of what causes the distraction from driving.

Could be.. my opinion is that the risk of a 2wd v a 4x4 is probably negligible. I've seen some really dumb things done off road by the 2wd crowd.... just a guess though. I only deal with what happens after the loss.
