Yea i was thinking of that bluff as well. The insurance is GEICO. And i hope we settle quickly though.

No experience with them, sorry. Mercury was quick on the ball to get things done and off the books. They hassled me for like 3 months to sign the settlement papers.

How did uou handle their calls? Im just wondering as far as what to say to them so they get the ball rolling

Once they accepted claim, there wasn't much to handle, especially on this last one since it was a major wreck and their insured was without a doubt 100% at fault (also put me in the hospital for 4 1/2 days) If anything I was dodging calls because they wouldn't stop hassling me. You can always go with a demand letter to the adjuster laying out your claim and your expected payout. Look around on the net for personal injury calculators to figure out what it's potentially worth. Send it certified mail. You most likely won't get what the calculators tell you (because of policy limits), but it's a good starting point to show that they know you're looking for money and how much you're looking for.

Cool man thanks. Anything else i should add on? Like pain and suffering or should i just go for wage lost?

You definitely want the pain and suffering, that's the personal injury part of it. Lost wages just kind of fall in line with that since HR took you out. Keep in mind that if you get paid lost wages, SDI can go after a repayment since they've been paying you this whole time. Seriously, California rules fucking suck when it comes to a third party payout. The liberals have made sure everyone gets a piece of the pie. In the letter you're going to want to layout how the injury has kept you from working, how it's affected your personal life, how it hurts daily, etc. I had to do this with my first accident, and it did help get my settlement bumped a couple thousand, but they still wouldn't give me what I wanted.

Wait what????? Are you serious? So if im getting SDI i have to repay them if i settle with the insurance company?
