I live up on a mountain with very few houses built on the lots. Every year we have thieves steal wood from various lots all over. The police tell us to put up no trespassing signs but do little if they are still caught. They take off before anything can be done.

I caught two guys, older maybe in their 50’s, in a truck with a trailer cutting wood and confronted them last week. They said they had permission from Don, no last name, I said that’s not who owns the land. They said the tree folks, contracted by the power co., gave them permission, no they can’t give you permission. Well there’s a six foot setback from the road, you are a lot more than six feet on that land. I told them they need to leave if he didn’t have permission. He started to give me some flack and I just continued on my walk and 10 minutes later they and the wood were gone. The lots all have no trespassing signs up.

I confirmed with my neighbor that I was the only one he had given permission to cut the trees up on those lots.

I have found out who they are and have pictures of them and the truck on the lot. They live two streets over about a mile away.

    What would you do?

i would think that if they had trees on their property, that the cost to cut elsewhere wouldn't make sense?:notsure:

Curious. Are they felling live timber or dead? Or cutting up already fallen dead stuff?

Not that it matters to much; theft is theft.

However, there may be some other agency interested in non-permitted live timber harvesting?

Maybe give the landowner the info you have or find out about?

BTW, I worked for a power company for 30 years, including lots of right of way legal work. We NEVER allowed private parties to cut anything in fee owned R/W, and of course only the landowner in easement R/W. I seriously doubt any power company would grant anyone 'permission' for private harvesting. Too much liability.

He's been doing it on the next street over too and has a sizable pile of firewood on both of their properties. They are trees the power co. had taken down. I had thought about getting a few friends and going to their house and just loading up all our trucks with wood and "Don said we could" would work just fine. The only problem is I know they are both hunters and guns and privet property don't mix. They both own lots with only a few trees on the boarders of their property.

I also posted on a local FB page about it to find them and I now found out THEY ARE MEMBERS of the same group! I got permission from the mods to out them, photos and all. I think I'll turn the photos and information over to the sheriff and see what he does. I found out that the sergeant is more willing to do something about it.
