    It really boils down to 2 asshats sitting in the middle of the roadway when the red car should have been in the center turn lane with a blinker on and the white car should've been back in the parking lot waiting for clearance to complete their left turn and not block lanes of traffic. Once again in America, the person minding their own business doing nothing wrong takes a fucking from inconsiderate selfish idiots thinking they have right of way to do whatever they think they need or want at whoever else's expense because their shit is so much more important than anyone else's. Too typical nowadays. But if OP would've demonstrated any disgust with their nonsense then instantly the asshats become the victims. Such bullshit. Armor up for the next idiots.

    I guess the armchair quarterbacks think OP had time to slam on the brakes so someone could rear end him and the 2 causing the shit to begin with could just drive away and then there'd be 2 innocent people with damage and none to the asshats. That'd been even more ridiculous.

    While I agree with most of what you said, you don't need to sue to get paid a Diminished Value claim. You would only sue if you don't like the settlement offer given by the insurance company. I've never had a DV claim go to suit. If we can't come to an agreement, I'll offer to have an appraisal done and whatever the appraisal says, that's what I'll pay. Sometimes the appraisal is more than my offer, sometimes it's less.

    And mental anguish... you can make an injury claim but if you want to be paid for mental anguish, you'll need to provide medical documentation from a psychologist or licensed therapist documenting you mental issues derived from the accident. In about 10,000 claims I've handled, I've had two cases of mental anguish proven and both of them involved people who witnessed a death.

    You need to un bunch your panties...nobody knows if anyone was behind him. You are the ultimate armchair quarterback at this point. I and others have only said BASED ON THE VIDEO it looks like it could have been avoided. Thats why i said don't show it unless it was absolutely needed, because when you see the videos all this crap comes up. Vs saying...she pulled out from a parking lot and i couldn't avoid her....see the damage. End of story.

    Anyway glad no one was injured, that video was tough to watch regardless. There's a lot of stoopit on the road these days and unfortunately you met two of them that day. Now I want a dash cam...there's an app for that I think.

    Ain't no panties here chief and if the people in both of those cars could read their driving instruction book or read traffic this wouldn't have happened. How about instead of armchair quarterback we just go with "all those that weren't in the truck at time"? Better? No need for butthurt, wasn't singling anyone out other than the 2 stupid wreck causers. Story isn't over until OPs truck is made right. I'm just tired of stupid people making victims out of other people who actually pay attention and have respect & consideration for others. Betting there is some jargon about duty of driver to not take the right of way from the others who have it too.

    In the eyes of the law OP was not at fault. I can tell you the perceived physics of a GoPro video can be wildly different from physics in real life. It is kind of like when I film myself going off of mountain biking jumps/drops; it looks real scarier in person and the video makes it look a lot tamer than it really is. Same goes for GoPro car footage. It is really easy to think OP could have just gone from 40-0 mph in 10 ft when in reality the universe isn't so forgiving.

    Although in this case, not really important. Liability in this situation is very clear. What's the driver of the car going to say that would make the production of the video to the insurance companies important ? The sun was in my eyes ? The truck was going too fast ? Someone waved me to come out ? I've heard all those excuses and none of them mean squat.

    Too many fucking idiots on the road. Some don't look. Some look but don't see. Some just don't care. Neither of those 2 cars should be crossing during that time. There is barely any traffic in the opposite direction. The moron in the white car could have waited 5 more seconds to avoid the cluster fk! I don't know what the red car driver was thinking or maybe incapable of thinking. smh

    Yep dash cams are very valuable.

    What I don't get is why other drivers who pull into traffic can't wait 3 seconds for an approaching car to pass. They are so selfish or don't care that they impede traffic and risk accidents..

    In the eyes of the law yes...but the eyes of insurance are different. I would write the lady for failing to yield and went on my way but you would be surprised how many time ins. co's call and want to know about the other persons speed or whatever.

    I'm just simply saying that the video does not favor him other than proving she failed to yield. Depending on what state you live in insurance companies issue a % at fault and it comes down to duty of driver etc. I personally don't think he did anything wrong, but its not my job to keep claim payout low....nahh mean?

    I live in a world of video this, video that....its always less dramatic on video.
