    New airbag systems are very sophisticated. They have a slew of devices that detect changes in motion, current speed and the type of impact. It's likely the computer detected that there wasn't enough delta-v relative to airbag's position to warrant the deployment. Every time an airbag pops there is a risk to the occupants. When the risk of deployment is less than predicted injuries from the impact it will activate. Even then newer systems have a variable speed of deployment depending of the vehicles velocity. A slower impact opens the bag slower and faster obvious quicker.

    That looks rough!

    I'm glad he wasn't seriously hurt. Can't believe there are even people worried about him losing a new truck. Who gives a shit. Be glad someone wasn't killed. Can and will get a new one. Can't replace his life. Last thing I would care about walking away from that is oh no my poor new truck. Or will it be totaled or repaired. If just be thankful I still have my life, arms and legs.

    Why didn't you go through your insurance and instead speak to the other parties insurance? I have never spoken to another insurance carrier other than my own and I have been in 3 accidents.

    I did, initially. Until my pu$$y insurance company told me that they'll likely cover the damages after the other kids insurance told them that they won't cover it since they felt is was MY fault.

    I was hit by a drunk fucking driver that was ARRESTED for DWI after failing a field sobriety test. Fuck that shit. I never had an accident or traffic ticket, ever. Didn't want this to mar my driving record.

    I'm very glad that your brother (and all other parties involved) is alive and all right given the circumstances. For his sake, I hope he is diligent about medical treatment and surveillance; trauma from an accident like that may take awhile to show effect.

    If I remember correctly, air bags only are deployed from a frontal or side impact, not from the rear.

    From my experience the settlement is in thirds. Medical. Lawyer fees and Pain and suffering (dependent on medical bills.)

    Property damage is a separate claim. IF you get a total, no diminished value. Since it was a business that hit you you should be made whole on a new truck. (minus the mileage value) Another driver (especially young ones don't carry enough insurance to cover property damage at $25K or more than minimum liability) So you have to use YOUR insurance who will not pay diminished value. Under insured is the best coverage one can get.

    Yours looks like a total and he was hit by a business who I am sure is covered to the teeth.

    Good Luck, I have handled my own cases in the past successfully. Sometimes you are better off handling your own case with the Insurance companies when you are at 0 fault. If things get froggy you can always hire a lawyer but the damages will include his fee.

    He should See a doctor just in case. But don't look for a giant payoff without major injuries. Outside of the obvious property damage, he will only get pain and suffering if he suffered and have the medical bills.

    $25K in medical should usually bring you $25K more in pain and suffering and $25K to the lawyer.

    People won't get much if they don't have major medical issues. My wife was hit by a drunk driver and her medical was $5000, We got $5000 extra after all was said and done as well as diminished value since it was only $10K on a $16K value.

    If your brother goes to see a doc, really push to get images taken...MRI etc...also get it done asap. If you need to have a case later for a disability claim you will need the most recent med records post-crash. Hope everyone is OK, sorry to hear about this.
