OP I would at least pursue an extended warranty from Toyota, once you mention your rights under lemon law as others mentioned they will be more willing to do so rather than a buyback/new truck. I'd ask for a 100,000 mile/7 year powertrain at least.

sigh! three weeks have gone by.. still no email, no calls and no truck . (I intentionally don't answer if they call so that they e-mail me each time our communications, I kept my cell phone number and home address from all paperwork when purchased, and gave office no. and address.)
It's hard being patient and waiting,.. patiently and being nice to them, when all I want is to call and angrily ask for my truck back. :annoyed:

@thors.hammer : I don't know if I could get an attorney involved and fight such a Big company and get a new truck. It's not like I bought the whole truck out of pocket you know. We only put down $25K. $10K precisely is borrowed money from Toyota Financial Services, which they've offered us. (the truck was $35,550 out the door). I just had to make my first car payment this week too. So I don't know, if I upset them, they could ask for the whole money back or do mean things to make my life difficult too. All I wanted was just a working truck. This is so sad. Waited all life, after driving the same old car for 17 long years (Dad got me a used old car for school), and I finally save enough to buy and bring a beauty home, only to get it snatched right out of your hands.

I feel like the small girl who's new red tricycle got stolen by the neighborhood mean kids :(

Eden if you need an attorney keep in mind that lemon law statutes generally include the provision that the manufacturer has to pay attorney costs. Check the specifics for your state, and if that's the case you shouldn't have issues finding someone to represent you. A good lawyer will account for their billable hours and send the bill to Toyota once everything is settled. If an attorney wants a retainer or bills you instead, move on to someone else.

All that said I'm hoping you get a full repair shortly without the hassle of going through this. Even though a new truck sounds appealing, dealing with legal stuff is soul crushing. But by all means keep reaching out to the dealer for a daily update if for no other reason than to keep some pressure applied.

There now is a TSB for rear differential leak. Not sure what exactly is the cause or fix. I'll check more when I get a chance.
