Bak MX4 tonneau trifold on 09 DCSB

anyone else have a disappointing experience with the new MX4?
I was reassured by AutoAnything that the tailgate could be closed without lifting the cover (Bak calls this "a new universal fit!"). I even had the sales rep double check w bak industries and he said it would work as advertised.
Well...
It arrived yesterday and I happily installed it without any issues. Easy and fast. The problem is it does not look that great with front bed overhang and a tailgate seal that does NOT function when closing up the gate. This was their big sell and why I was willing to shell out $ on this company. I'm in and out of it all the time and limiting a step appeals to me.
I called bak industries and the guy says "yeah, since you have a 2009 Tacoma you have to open the tonneau to close your tailgate."

I thought I had received the wrong model. In fact their final panel is modified for the lower tailgate cap and it looks like they just didn't care to finish off the product- exposed metal not painted.

Should I tolerate this from Bak? How many 2nd gen tacos are there in the world and this is supposed to be a premium cover option? I know it's not OEM but it is $800+


☝ Yeah, that's in the closed position. Is it me or does this look like ?

Wondering if all my options will be as irritating as toyotas decision to make an uneven bed/gate rail
