    UPDATE**** Toyota called and rats nested in my engine and ate through multiple harnesses (because of soy based wiring)...use moth balls or spray like Natural Armor Animal Repellent and try and park in garage if you can (might not help much, but mine was in driveway almost exclusively and driven almost daily).

    I have owned my 2016 TRD OR since July of 2016. It had the common problems associated with the list on the TSB for shift flares, park to drive delay, and cruise control. The rev 1 fixed the issues. This morning, I started the ignition and was met with the "trac off" and check engine light. I attempted to drive to work and the truck would not shift past 1st gear. It acted as if fuel was not getting to the engine occasionally and it would barely climb slight grades/hills.

    I called the dealership and they said it was okay to drive it to them so I did. I dropped it off and was planning, on my return to pick it up, to ask them to either assist me with dealing with corporate in asking for a platinum warranty (I am not sure if it is corporate or the dealership that can offer that) or getting me into another truck. Before that, I received a call shortly thereafter from the person I bought the vehicle from and he advised that he has the same truck but in 2017 available for the same monthly payments. I told him I would consider it and that I wanted to see what was wrong with my truck first, but wanted to reach out to y'all first for advice.

    I may be jumping the gun, but I feel like this truck has too many issues for a brand new truck. I am aware from the forums that many people experience just as many issues with the 2017.

    My question is as follows:

    1) I have 9 months of paying principal towards my truck. My loan is 1.99% so I have paid 4,049 in principal and 563 in interest. What would be a fair deal in terms of getting me into the new truck. I really prefer that they fix this one, because I don't want to lose the 4K in principal I have already paid and essentially start over, but I am also concerned that my truck will continue to exhibit problems. I am frequently out in the middle of nowhere and, had this happened then, it would have been a much larger complication.

    This is the first new vehicle I have ever purchased and I am not well-versed in these situations. Thank you for any input.

    Straight even deal for new vehicle you should have no economic loss these issues are are the fault of the consumer.....

    Would another option be to get your money back and get into a vehicle thats not a Tacoma. Don't get me wrong, my '17 is awesome, to me at least. But if your skeptical, perhaps you may want to consider other outlets?

    The 17 may have the same issues that the 16 has and then you will be out of the money difference.

    KBB the private party value of your truck. Deduct that from the OTD price of new truck. This will give you the depreciated value of your current truck. From there, you can decide if it's a good choice or not.

    Thank you for the responses. I enjoy the truck. I am just not sure if mine will continue to have issues as it has been in the shop a total of 23 days prior to this incident. The KBB PPV is 31-34K (it has 5K miles on it). Walking the dealers lot, the same truck as mine in 2017 is 37K MSRP, so it would be around 41K after taxes and fees if they didn't negotiate. Essentially I would lose about 8K on the deal. I cannot stomach that loss for something that I bought so recently, so I guess I will stay with this one or ask for my money back assuming that is even an option. Texas lemon laws do not appear to be consumer friendly. Thanks again for the responses. I will let y'all know what the dealer says.

    Lemon laws are not easy to process as one would think they would be. Dealerships will continue to give you the run around telling you they cant duplicate or it's your fault. I had a buddy with an Infiniti that lemoned on an electronics side. Dealership gave him the run around for a couple months. Buddy finally bought a code tracker and recorded every time it happened, he lawyered up and they lemoned the car. Received full refund of payments and used it to buy a year newer model hybrid version and it's been an excellent vehicle since.

    23 of 30 days..... and now back in the shop.. yer almost there maybe why they are offering you a 17, its going to be better to sell the old truck if its not considered a lemon... they would have to tell the next owner its a lemon buy back... if they buy it back before it's lemoned, they can sell for higher price. So that makes up the difference for you to trade straight up for a 2017... or you can wait until they have to buy it back... which is always more costly to the dealership. So you have some leverage now... I'd trade EVEN UP for a new 17....

    Lemon law specifics vary by state.

    You really need to find out the specific rules and conditions that apply to your situation before you do anything else.

    Once you have that info you'll be in a better position to decide a course of action.

    2017's are lemons too! Keep all your dealership documentation and as someone earlier said call a lemon law attorney in your area. The process may take a few months.

    The 2017s are 2016's with a new number and a couple non relevant upgrades. You run the same risks. Not worth losing money on. If you like the truck, have the dealer fix it and you keep the truck.

    The salesman isn't being your buddy, he is trying to make a quick buck on you and your despair.

    I will contact a lemon law attorney, but I don't know how far that will go because my money is stretched thin and I don't have much for a retainer, etc.

    I went to the dealership and was offered the following: Same make/model 2017 as what I currently have with same features (tow package, etc.). It would be ordered from the factory and delivered at unknown date (few months). The principal (equity that I have in the current vehicle would be rolled over to the new vehicle and the dealership would buy the loan from the credit union. The dealership would then finance me at the same interest rate but would not run a hard inquiry. The only thing I would lose it appears would be approximately 200 dollars in taxes. My payments will drop about 30 a month because of the equity that would be rolled over. I told him I would wait to see what was wrong with my current truck.

    Eh, if you would truly only lose $200 on it, I'd go for it. That's worth the new vehicle + renewal of warranty in my mind.

    That's honestly better than you'd probably get lemon law'ing it.

    OP Lemon Law Lawyers do the work and if and when they get you a settlement they will take a cut, no retainer needed. They will not take your case unless they think they can get a settlement from the Manufacturer....

    exactly and they'll nearly all offer a free consult.

    If you're keeping the same (or reducing) payment and the end-date for the payments remains the same, with only about $200 out of pocket to get the same truck, that's really not a bad deal.

    The only thing is remember words are worth the paper they're written on. Ensure any deal is fully in writing and is specific in terms of time frame, costs, etc.

    Also make sure you're not getting nailed on sales tax or similar purchase tax. Amount usually depends on the difference between trade-in and purchase values; which they may be stretching together to minimize the tax impact. Just ensure you know ahead of signing anything.

    BTW, any paper they want you to sign you ask if you can take it home to review it overnight. If they're playing it straight they'll have no problem with that. If they start pressuring you that the offer is only good right night, that's a big red flag telling you to walk.

    Go for it, get the new truck as long as the dealer is not changing his mind. Tacos are good trucks, better compared to the other brands.

    That is sage advice.... The dealer may know something about your truck you don't know.... and is hedging bets for better re-sale of your truck. Has to be something there like that.... dealers usually don't do stuff unless its to make a buck or 3.
