    What! That's a crock of shit. I would imagine that this varies by insurance policy and differing state laws, but who the hell knows.

    The tree had no signs of rot or anything...no dead branches or anything.

    My dad, who has been in the insurance business for his whole career laid all these facts down. He did say however that if the neighbor noticed dead branches hanging over onto his property, once you tell the property owner that it needs cut, they do become liable at that point. However I could see how some douchebag could lie about not being told.

    BTW the property owner now has a big stump in his yard to deal with. Would have been smart to go in together and split the bill at least.

    That's really strange. I've had them cover it when a tree fell on my house (twice- same house!!) but they won't cover it if one rolls down the street and into your house?

    Insurance calls those "acts of god" sucks but it is what it is. At work one of our trees fell and hit someone's car, no rot or anything on the tree just a freak wind gust. Insurance said it was their insurance's problem.

    If it causes roof damage I think it changes the terms of coverage...as in they'll cover damage to the roof and that's it.

    I just found out that the tree removal cost was split between the neighbors...that's good news. That's also the neighborly thing to do. $700 must be the going rate for that job around here. It was a large tree.

    Same way I would approach it. A tree fell onto my backyard 2 yrs ago and just missed my shed. It was right on the line and I'm not sure if it was truly shared or whose side. We both said we would let the fellow on the other side of me have the wood if it was ours alone, so simple fix.
