Farmers want to total my truck

    Just going to throw this out there...

    You don't have to use insurance at all. Yours or theirs. Get estimates or repair the vehicle (make sure it's is less than the value). Then go after the driver that hit you. They refuse to pay? Take them to small claims court. No reason to use insurance unless it makes your life easier.

    Small claims may be it. Farmer's will still have pay but at least an unbiased judge will make the decision. Farmer's has had this rigged from the time I seen their adjuster. I have three years, but they are in a hurry.

    Their up to nearly $3000 (I keep the truck) and just over $500 for the car rental I did not use. I have to have an extension ladder to get to work. Besides they said it would take a few days to get a truck. I hat to fix my truck to get it road worthy to get to work. Another $500 and their there! I'm not sure how to ask for it?

    I have the police report. I tempted to just go and talk to the guy and tell hip his insurance stinks. I'd like to forward him our email chain.

    Another $500 for my time/lost work and I'll settle.

    FWIW, I took my 03 in for a frame inspection recently. Salesman scum comes to me telling me that it is worth a lot and can get a good trade on it. I asked him for an appraisal and he said it was $6-6.5K trade-in value. I was shocked it was so high and he won't stop calling me.

    I sent them this
    I'm done haggling, but I will learn how to use small claims court if he tries to. I'd rather get nothing from them then sale them my truck for $5100 (can I get lube with that?)

    No it's at $3500 and I keep the truck. I asked for $250 more and tomorrow they will own me another $25 for the acceptable rental they failed to get me (state law until I settle.)

    Cooked Farmer in Kansas Said no. I'm going to have to get all legal with him. So I read up on the law today and wrote up this response.
    I need a lawyer but if anyone has free advice I would appreciate it. I've lost a lot of sleep over this.

    Ask for what they're basing the value off of CCC valuation as I stated in a prior post. They could be picking three shitty trucks as a sales comp.

    Most examples in the CCC are great low mileage trucks. All cost more than they price mine. It's just their assessment from the a blind man is that mine is it's a wreck. I think there is a real problem with it. If I get this to a judge they may pay out more than the shop wanted to fix it ($5992.) I hope the tire issue will get their assessment tossed. I need a better one from a few local dealers (more Utah law.)

    There is no need for the cost of a lawyer in this. Can you please layout all the information for us?

    Do you have a police report that shows fault?

    What is the value of your truck?

    Do you have a few estimates of the cost of repair? If so, what are they...

    Luckily Utah has a small claims max of 10k so you are well within that.

    Edit: from now on, make sure all communication is done with email, for documentation/memorialization

    I'm working on it. I have the report, but liability is not in question here. I need it for his address (I only have his name.) Any offer from Farmers proves liability. My insurance made certain liability whet to Farmers. The Camry I hit cost Farmers a bundle and I think they intend to take it out on me the working man with out an advocate (bad faith.) I have an estimate from a blind man. I'll get more but I've fixed some of it by now. I want to fix my tail gate too. It sucks driving around with it.

    I called Alex (the guy that rear-ended me.) I told him Farmers was trying to steal my truck and I may have to sue him. I also said I had no animosity towards him. He just made a mistake. He's just a working man like myself. He just made a mistake; not just when he hit me but when he insured with the Farmer. No mater, Farmer will pay. Alex is a good guy.

    I sent him that email at 1:00 am. Today at 6:00 am I asked for the salvage yard and what they had offered. State law states they can not withhold that.

    They clearly do not care about state law. Off to court we go.

    Crap, I just noticed their crack head adjuster did not select my options right in his CCC. SR5, TRD, cruise, CD, Alloy wheels, E-locker and even anti-lock breaks (wtf?) Then there is Bluetooth too. Just noticed they missed spay-in bed liner. $400 in the estimate.Maybe this is why I feel so violated. Blind man did this. First my new tires were bald, now I finally find this. My vision is getting bad too. Funny thing is the body shop list had all the right badging. They knew and just want to screw me over the '15 Camry my Taco pounded. That car cost them big. Crooks all of them.

    They think I have a 5 lug 4x4 without anti-lock breaks, and they have pics. This my also explain the $160 for a set of new tires.

    This story is crazy. Every time I've had insurance claim they have sent me a check for the "estimated" cost to repair or replace.

    Only time I had any problems my insurance, USAA, sent me money and went after them.

    Fight them all the way

    Me too. I've never dealt with assholes like these. My wife totaled a year old car that was upside down $3000 and I liked that experience more. Well not really, just the insurance part. She should be dead. It was with a semi. Full coverage puts a-holes on your side (there's a jingle there.) I never really seen it that way until now.

    It's looking like my truck might be worth $8000. If it's $7870 or more it's not a total anymore. Utah law is the repair is 75% or over the replacement cost. But these a-holes have no regard for the law or the contract they have with the guy that hit me. Bad faith it's called. Others might do it too but none have done it to me as far as I know. Farmer's insurance are acting in bad faith to Alex.

    I should also find another shop that will fix it for less. And there was some betterment in the estimate at their shop and that I should have to pay for under Utah law. A new bed floor would look nice in there and my tailgate had some other issues. Some dings in the bed sides and brush scratches too. Though not in the estimate (just remove/replace) it needs a new spare tire carrier due to rust. I really did not want them to just paint over the blemishes.

    If you keep fighting the insurance company and threaten to sue, they will give you something better. Be sure and speak with higher ups, not the morons answering the phone. Usually they lowball you in the beginning for obvious reasons, then they reckon theyll have to deal with you if you dont take it.

    there was a recall on the spare tire carrier, check it out, you might get a new one from Toyota for free
