I have to be careful with this vehicle and remind myself that no dipstick and low xmission fluid from factory is unforgivable....

No tranny dipstick in ford's either. My 2014 F150 and my kids 2002 Explorer had no tranny dipstick. Nor does our 2016 Escape.

Just as an FYI, you are not hosed if you sign an arb agreement as it relates to LL. If you buy new where I live you’ll sign one or not buy. It does help protect the dealer but does not absolve the manufacturer from their responsibility under the LL. I have handled my share of LL issues and not once has an arb agreement been an issue with the manufacturer. Dealer is a different story but if they screw you over on a non LL issue invoke arbitration if needed. It costs them money and they know this. If they have someone that is digging in they will try to help to save money but LL issues are clearly between the consumer and manufacturer with state law applying. Generally speaking dealers do not fare well when they get sued or even in arbitration.

    Best of luck...

Are you a lawyer? I suspect not. Dealerships have you sign an arbitration agreement for a reason.Have you ever read your agreement in its entirety? If you think for an instant the dealership has your best interests at heart by offering this agreement, then you are ..... as you sound. Here is one reference from a practicing attorney:http://oppositelock.kinja.com/avoid-arbitration-the-podcast-you-can-watch-1709545527. Where is yours? Here is a quote from California lemon law attorney group:
    • The nonprofit consumer group Public Citizen analyzed data the NAF (an arbitration firm) provided to the state of California, one of the few states that actually requires arbitration firms to disclose information about their results. Public Citizen found that in 94 percent of 19,000 cases, NAF arbitrators ruled in favor of the businesses that hired them.

You misread my post or maybe I was not clear. Yes. I am a lawyer (a very good one) and have been for 21 years. The dealership only has their best interest in mind - always have had and always will. We agree on that. What I am saying is that the LL process is between you and the manufacturer after a requisite amount of failed repair attempts (depending on your state law). The dealer is generally the one stuck in the middle because they either cannot fix your vehicle or will not if the manufacturer won’t authorize the fix. For the record, I despise arbitration agreements and think they are a sham in most instances. But, you can invoke it and be successful BUT the shame of it is that you will generally have to split the costs and they can be substantial. I have succeeded all 4 times I have used the LL for my personal vehicles for what it is worth.

My favorite case is where the stealership simply refused to pay for the arbitration and the poor owner had to wait 7 years for the arbitration to clear before winning a suit. There does not appear to be any information on the webs regarding which dealerships if any do not have arbitration agreements. Nissan is sneaky and adds it to their warranty booklet that is referenced in the fine print on the purchase agreement.

I used to walk away from dealers with mandatory arbitration agreements but now it is hard to find one that doesn’t have them in place and it’s a shame.

Orangevirus.com has an $800 download and there's a product called Shift Sense some people have found helpful but nothing from Toyota to fix the issue.

Do a search for both of those on this site and you should find lots of pages pertaining to those two products.

SSO hybrid bumper, Warn winch, RCI skid trilogy, RRW sliders, everything in the cheap/free mods thread, and of course the frame recall work.
Had this TSB implemented today. Works like it should always have worked now. Shifts are smooth, no hunting on highway, R to D is immediate. I will have to try to do a Rockford on a dirt road!

Finally got around to getting this TSB done. The original one was night a day for the issues that I was having hopefully this will take care of the annoying shifting patterns.
