Damn dude. I'd be fucking enraged! Maybe this other deal can find and fix the problem. Then, maybe go after the other dealer for a refund on your $5k.

How does a vehicle fall into the lemon category and how do you file a claim?

Have to research that yourself, every state is different.

    Consider consulting a lawyer.

Any updates here? I'm following some CKP threads. Thanks.

Interesting timing actually, right now I am sitting in Stapp interstate toyota. Today I drove up to fort Collins to pick up some skids I bought from RCI metal works. While I was driving back home my truck started surging and losing power. I pulled over and turned off the truck. Waited five minutes, turned it on and it drove fine four about ten miles. While going abound 80 on I-25 the truck jolted lost power I heard an audible clanking sound and the truck started surging very badly until it died and I was left on the side of I-25. The truck wouldn't even start, I called a tow truck and had it towed to the nearest dealership. They will look at it tomorrow.
While I was home in NM I tried to get the problem diagnosed. I took in to American toyota. They said they couldn't find anything wrong with the truck. The tech said no codes popped up and they couldn't 'replicate" the problem. Unfortunately I couldn't leave the truck there longer. I drove back up to Denver on Saturday. Everything seemed fine and the truck was working normally until today. This whole situation has made me very depressed and has destroyed my confidence in the vehicle. I really love this truck but if this ends up costing me more $$$ I will be looking to get rid of it. Time to slog a few cold ones.

    Hmmmmm.

In Ft Collins I bought my Toyota SR5 '86 4X new at the Dealership there. Just sold it like a month ago.

So post back in what they find. I understand you to be saying they found nothing on your last iteration of problems? I suppose that doesn't sound too good. Maybe you could qualify under lemon laws.

Will do, I'm still under the 60K powertrain warranty so hopefully that's worth something.

I don't know what I would do if I was you. I'd hate to take a beating on trade in, but having no confidence in a new vehicle is unacceptable. I might leave it unlocked in a bad part of town and hope for the best/worst. Just no soup kitchen...

If is the root of the problem then no I wouldn't want to trade it in. Either way something fucked up and it should be addressed by Toyota or the dealership that worked on my vehicle.

I hope the dealership gets it fixed. Maybe you should call Toyota corporate customer service and let them know about all the trouble you are having. Not sure if they can do anything but it's worth a shot

Sounds like the truck is going through puberty.

In all seriousness, good luck finding a remedy. We are looking to you for keeping the MT name clean ;)

Now that I don’t commute everyday a MT might be in my future in this truck doesn’t pan out.

In that case come join the good side. Haha. The water is warm over here.

OP--I know there has been some downtime due to holidays that the Dealership has not been working on your truck, but what is the latest update on your truck and its issues at this point?
