    Does his sleeping constitute a safety violation?
    Kick him in the tainght.
    Then write him up.

    Or you could do like a buddy of mine used to do when they were patrolling at night. They would setup a surveillance at night. If he was driving and his partner fell asleep. He would quietly drive the car and park it front of wall or a parked semi then wake the partner up by laying on the horn and shouting a string of expletives about how they’re gonna die.
